Approval of Minutes: a) Minutes of Development Services Committee meeting held on Wednesday, December 6, Motion No. DSC Moved by Coutanche, Seconded by Macpherson It is recommended that the draft minutes of the Development Services Committee meeting held on Wednesday, December 6, 2017 be received and approved as printed and circulated. 5. Public Meetings: a) Notice of Receipt of a Complete Application, Notice of Particulars and Public Access, Notice of Public Meeting for a Proposed Amendment to the Zoning By -Law of the Township of Oro- Medonte, Part of Lots 1 and 2, Concession 3, ZBA- 14 Skyline Utility Services Inc.) and Consent Application B- 25. Deputy Mayor Hough called the meeting to order at 5: 35 p. m. and explained the public meeting is being is being held in accordance with Sections 34, 53 and 54 of the Planning Act, to obtain public comment with respect to the proposed Development Applications. The purpose of Application ZBA- 14 is to rezone the subject lands from " Agricultural/ Rural ( A/ RU) Zone" to " Agricultural/ Rural Exception ( A/ RU") Zone" to permit the development of an outdoor Nordic spa with associated uses ( corporate meeting facilities/ chalets, restaurants/ bistros, administrative offices, retail uses and personal service uses). The purpose of Consent application B- 25 proposes a severance for a lot creation. Josh Morgan, Planning Consultant, Morgan Planning Consultant, on behalf of applicant, provided a planning overview. Stephen Morash, WMI & Associates Limited provided comments with respect to water capacity. The following public persons offered verbal comments with respect to the proposed amendment: Ian Veitch, on behalf of Horseshoe Valley Property Owners, Board of Directors, provided comments in support of the application. Comments included support in the development of this nature, benefits to the community including health/ well- being, passive use application, blending with the rural lifestyle, no noise impacts, traffic questions have been addressed, water and sewage is being addressed privately and no outstanding concerns. The following public persons offered verbal comments: Celeste Phillips, Celeste Phillips Planning Inc., on behalf of Howard Leake and Pauline Grenier, provided comments that the application is not minor, the impact of the variance with respect to loss of light, spacing, openness, privacy concerns, not desirable of lands, affecting the enjoyment of the property and building in accordance with the bylaw. Kim Whyte provided comments that the application is not minor, survey/ boundary/ hedge/ easement concerns, opposition comments of encroaching on her property, privacy and well- being concerns, the placement of property stakes and comments that the application should be reduced. Darlene Galic provided comments of height of dwelling, fence comments, understanding easement and private property rights. Howard Leake provided height dwelling concerns, comments that the application should be in accordance with by- law and the potential fence cannot interfere with access at Lake Simcoe. Page 5 of 17

A server farm means a group of computers acting as servers and housed together in a single location and tied to an office for technicians at the location. A Web Server Farm can be either ( 1) a Web site that has more than one server, or (2) an Internet service provider that provides Web hosting services using multiple servers; b) That the proposed buildings/ structures and landscaping on the property be substantially and proportionally in conformity with the dimensions as set out on the application and sketches submitted and approved by the Committee; c) That the applicant applies for and obtains Site Plan approval from the Township with respect to the construction of the proposed buildings; d) That the applicant applies for and obtains a Ministry of Transportation Building and Land Use Permit; and, e) That the appropriate Zoning Certificate and Building Permit be obtained from the Township only after the Committee' s decision becomes final and binding, if required, as provided for within the Planning Act R. That the Development Services Committee grant provisional consent to Application B-08 to convey a parcel having an area of approximately ha ( ac), and a lot frontage of approximately m. ( ft.) located on Part of Lot 1, Concession 1 ( Oro), Township of Oro- Medonte, known as 1 Trafalgar Lane, subject to the following conditions: a) That the applicant signs the Township' s Memorandum of Understanding by which the applicant acknowledges the requirements and timing of matters that may include: payment of development charges, payment of cash in lieu of parkland, detailed design of a building or septic system, engineered lot grading, and water and sanitary servicing, on either the vacant severed or retained parcel; b) That the applicant dedicate to the Municipality a fee of $ 2000 as a parkland contribution for each new lot created for residential purposes as cash -in -lieu of a parkland contribution pursuant to By- law under the authority of subsection 53( 13) of the Planning Act, R. S. O c. P. 13; c) That one copy of a Registered Reference Plan of the subject lands prepared by an Ontario Land Surveyor be submitted to the Committee Secretary -Treasurer which conforms substantially with the application as submitted; Page 14 of 17

15 d) That the applicant' s solicitor prepare and submit a copy of the proposed conveyance for the parcel severed, for review by the Municipality and for use for the issuance of the certificate of consent; e) That all municipal taxes be paid to the Township of Oro- Medonte; f) That the Certificate of Consent be issued utilizing Form 2, Section 53 ( 42) of the Planning Act, R. S. O. 1990; g) That the applicant apply and be approved Site Plan Approval from Council to implement recommendations set out in the Natural Heritage Investigation, the Natural Heritage Evaluation, protection of the 30 metre vegetation zone, existing woodland and other restored areas, and to identify the need for permit approval under Ontario Regulation 179/ 06; h) That a Planting Plan be submitted to the satisfaction of the Lake Simcoe Region Conservation Authority for the 30 metre shoreline vegetation protection zone associated with the retained and proposed lots, the existing septic system area and propose lot line area; i) That the Lake Simcoe Region Conservation Authority is notified in writing when the septic system has been replaced with a tertiary system located further away from Lake Simcoe and on the west side of the existing dwelling; j) That the applicant apply and be approved a Zoning Amendment to rezone the severed and retained lands to the Shoreline Residential ( SR) Zone as well as to the Environmental Protection ( EP) Zone to protected the Natural Heritage features identified in the Natural Heritage Evaluation and LSRCA; k) That the conditions of consent imposed by the Committee be fulfilled within one year from the date of the giving of the notice; and. 3. And That the following conditions be imposed on the Committee' s decision: a) That notwithstanding Table 131 R1 Zone of Zoning By- law 97-95, the proposed addition to a single detached dwelling shall otherwise comply with all other applicable provisions of the Zoning By-law; b) That the proposed additions be substantially and proportionally in conformity with the dimensions as set out on the application and sketches submitted and approved by the Committee; c) That an OLS verify by pinning the foundation wall and verifying in writing by way of survey/ real property report, prior to the pouring of the footing and if no footing, the foundation, that the proposed addition is in conformity with Committee's decision; and; d) That the appropriate Zoning Certificate and Building Permit be obtained from the Township only after the Committee' s decision becomes final and binding, as provided for within the Planning Act R.
