This is to ensure that infill development is context appropriate and compatible with the physical character of the existing built form, including information from WSP Engineering Consulting Services, as part of an additional scope of work within the new city-wide zoning by-law project. The motion approved by Council also directed staff to report back to Council in January 2018 to present their findings and include an estimate of the cost of adding this scope of work to the new city-wide zoning by-law project and the timeframe under consideration. This report provides a recommended approach for Reddendale that ties together the elements of land use planning and stormwater management. The report also provides information related to the proposed preliminary scope of work, timeframe and budget requirements that will be needed to complete this work. Recommendation: That Council approve the scope of work related to the development of a planning framework for Reddendale as part of the new city-wide zoning by-law project, as outlined in Report Number ; and That Council approve a budget of $100,000 to be funded from the Working Fund Reserve to complete the planning framework for Reddendale; and Council Meeting 05 35

2 Page 2 of 7 That the Mayor and Clerk be authorized to enter into an agreement, to the satisfaction of the Director of Legal Services and the Commissioner of Community Services, for the purpose of amending the scope of work for the new city-wide zoning by-law project to enable staff and Dillon Consulting Limited to advance additional works for Reddendale as described in Report Number ; and That a Reddendale Community Working Group be established, in accordance with the mandate as outlined in Report Number ; and That the City Clerk be directed to invite the public to submit applications to participate on the Reddendale Community Working Group; and That the composition of the Reddendale Community Working Group consist of: (a) 1 member of Council; and (b) 4 to 6 interested members of the community who demonstrate a distinct and informed interest in community planning and development, with the selection to represent a variety of stakeholders including residents, business owners and property owners in the area, as well as representatives from any local community groups and not-for-profit organizations; and That the applications be forwarded to the Nominations Advisory Committee for consideration and recommendation to Council for final approval. 4 Options/Discussion: Page 4 of 7 Background On December 19, 2017, Council passed the following motion related to the development of a planning framework for the Reddendale neighbourhood: Whereas Reddendale is not included in the Terms of Reference for the Central City Growth and Infill Strategy; and Whereas there is a general recognition of infill development pressure that is unique in Reddendale; and Whereas an organized group has been actively working toward control of infill development in Reddendale for several years; and Whereas the City has already engaged WSP Engineering Consulting Services to complete stormwater evaluations in Reddendale in acknowledgment of stormwater neighbourhood issues which may be related to infill development; and Whereas WSP Engineering Consulting Services has a familiarity with the neighbourhood; and Whereas the residents have petitioned the City to have a planning framework to address their specific neighbourhood pressures and needs; Therefore Be It Resolved That staff be asked to advise Council on the feasibility of developing a planning framework that is specific to address pressures in the Reddendale area, to ensure that infill development is context appropriate, and compatible with the physical character of the existing built form, including information from WSP Engineering Consulting Services, as part of an additional scope of work within the Comprehensive Zoning By-Law Consolidation Project currently underway; and That Council direct staff to report back report back in January 2018 to present their findings based on sound planning principles; and include an estimate of the cost of adding this scope of work for the Reddendale area to the Comprehensive Zoning By-Law Consolidation Project; and an approximation of the timeframe under consideration including community engagement. The Council motion stems from the following concerns that have been identified by residents of the Reddendale neighbourhood: An increasing number of applications for new lot creation on historically existing larger lots; Large-scale additions and rebuilds that are permitted as-of-right by the zoning by-law and are not subject to planning review; Built form of new residential development that is not in keeping with the character of the neighbourhood; and Council Meeting 05 38

5 Page 5 of 7 The potential cumulative impact of new development on stormwater management in the area. The Engineering Department retained WSP Canada Group Limited to carry out a stormwater study in response to flooding that occurred in Reddendale during the summer of Initial findings from the stormwater study were shared with the Reddendale residents via and a public information session in late The Engineering Department has indicated that it will continue working on the next steps of the stormwater study which can help inform the planning framework that is being proposed for the Reddendale area. Study Area The study area is generally bounded by Front Road to the north, Sunny Acres Road to the east and Lake Ontario to the south and west and includes the residential area of the Reddendale neighbourhood (Exhibit A). The area is comprised of primarily single-detached residential development, a few neighbourhood parks and the R.G. Sinclair Public School. Most of the residential development in the area was established between the 1950s and the 1970s. Industrial development associated with INVISTA Canada is located to the east of the study area, across from Sunny Acres Road. The Henderson neighbourhood, the Reddendale Plaza commercial development, the city-owned Centre 70 Arena, the Royal Kingston Curling Club and lands associated with the Collins Bay Penitentiary are located to the north of Front Road. The low density residential development is zoned Special Residential Type 1 Zone in Zoning By-Law Number 76-26, with a few properties zoned Residential Type 2 Zone (Exhibit B). The area below the 76.9 metre Geodetic Survey Datum level of the shoreline of Lake Ontario is identified as a flood plain in Zoning By-Law Number The zoning by-law does not permit any building to be erected or altered within 7.62 metres (25 feet) of the flood plain. Status of the New City-wide Zoning By-Law The city is in the process of preparing a new city-wide zoning by-law to replace the existing separate zoning by-laws with one comprehensive vision for planning and development in the city. Work on this project began in April of 2015, concurrently with the Official Plan Update project. The first draft of the new city-wide zoning by-law was released to the public on October 27, 2016, which was accompanied by a series of consultation events held across the city. Staff are currently working to resolve a number of bucket issues that have been identified through the zoning by-law review process, such as short-term rentals, public versus private school permissions, the regulation of residential density, and parking review on a per-bedroom basis for multi-unit residential development. Staff are also working to update the regulatory framework contained in the first draft of the new city-wide zoning by-law to ensure conformity with the current policy framework, including amendments made through the Official Plan Update. Furthermore, the recommendations of the Central Kingston Growth and Infill Strategy, which is anticipated to be completed in mid-2019, will be incorporated into a future draft of the new citywide zoning by-law. 6 Page 6 of 7 Recommended Approach for Reddendale As per Council s direction, an additional scope of work related to the development of a planning framework for Reddendale is recommended to be added to the new city-wide zoning by-law project. This work will address the following objectives at a minimum: Review and analysis of the existing regulatory framework contained in Zoning By-Law Number for the residential area of Reddendale and the framework proposed in the first draft of the new city-wide zoning by-law; Review of existing on-the-ground conditions relative to lot size and area, yards, parking location and driveways, landscaped open space and building height; Development of a zoning framework specific to Reddendale, to achieve the desired character of residential buildings (as permitted by Section 34(1) of the Planning Act) to ensure that new development is compatible with the physical character of established residential development, for inclusion in the new city-wide zoning by-law; Preparation of area-specific design guidelines to ensure that new residential development is appropriately integrated in a way that respects the character and scale of existing residential development; and Recommendations with respect to the carrying capacity of the neighbourhood (such as the number of new lots that can be accommodated and the recommended lot coverage) so that new development does not negatively impact stormwater management on adjacent properties. The original scope of work for the Official Plan Update and the new city-wide zoning by-law project was presented in a report to Council on January 6, 2015 (Report Number ), and was executed through an agreement with Dillon Consulting Limited. The motion passed by Council to authorize the work set explicit terms tied to Dillon Consulting Limited s consulting fees and, accordingly, does not accommodate any form of contingency. Not including the stormwater study that is already underway with the Engineering Department, staff anticipate that the additional work related to the development of a planning framework for Reddendale will cost in the range of $100,000. The proposed scope of work may need to be further refined once it has been reviewed by the consultant. It is anticipated that the study will take approximately eight to twelve months to complete. Public Engagement Public engagement will be an important component of this work. It is proposed that as part of this study, a community working group be established. The role of the community working group will be to: Contribute toward the development of the study; Provide feedback on the study process; Ensure inclusive community consultation and engagement; Be ambassadors for the project; and Advise and inform the city of relevant community issues. It is recommended that the composition of the Reddendale Community Working Group consist of: Council Meeting 05 40
