Voice Vote: Unanimous PUBLIC HEARING SPECIAL USE PERMIT FOR USED TRUCK SALES / WINDYCITYJAY TRUCK SALES, 595 E. SOUTH FRONTAGE ROAD / APPLICANT: JASON DESANTO PROJECT NO.: Motion Wright, second Runge to re-open the public hearing. Motion carried, public hearing re-opened at 8:02 p.m. Planning and Zoning Administrator, Nicole Knapp, presented the request. Jason DeSanto of WindyCityJay Truck Sales is requesting approval of a Special Use Permit for Truck Sales located at 595 E. South Frontage Road. Knapp stated that the subject property comprises approximately acres, is currently zoned B-3 Highway Commercial and the property has two points of access; one from E. South Frontage Road and another from Joliet Road. Knapp also stated that per the Zoning Ordinance, Truck Sales require a Special Use within the B-3 Zoning District. Knapp further stated that currently, Brahler s Truckers Supply, Inc. occupies the subject building and site and that the applicant plans to lease a small office area within the existing building, as well as display trucks for sale in the north area of the parking lot. WindyCityJay Truck Sales would employ one (1) office manager and four (4) sales people. They do not employ any mechanics, as the service work (repairs, tires, windshield replacement, detailing, etc) is outsourced to a local business. The hours of

2 operation would be Monday thru Friday 8:00 a.m. to 5:30 p.m., Saturdays by appointment only and closed on Sundays. R ECOMMENDATION Staff recommends approval of a Special Use Permit to allow pre-owned truck sales at 595 E. South Frontage Road, subject to all State of Illinois requirements being met. SCHMIDT ROAD / APPLICANT: HERBALIFE / PROJECT NO.: Motion rashid, second Jacobs to open the public hearing. Motion carried, public hearing opened at 8:05 p.m. Planning and Zoning Administrator, Nicole Knapp, presented the request. Herbalife is requesting approval of a Special Use Permit for a Planned Unit Development in order to allow a Herbalife (nutrition and counseling office) to be located at 319 N. Schmidt Road. Knapp stated that the subject property comprises approximately forty-one hundredths (0.41) of an acre, is currently zoned B-2 Community Retail, and that access to the subject property is from two points on Schmidt Road. Knapp also stated that per the Zoning Ordinance, professional offices are no longer permitted uses within the B-2 Zoning District and that the applicant is requesting a Special Use Permit to allow a 1,240 square foot nutrition counseling office at 319 N. Schmidt Road. Knapp further stated that Herbalife is currently located within the shopping plaza; however, they are moving their business to a different location within the same plaza and need a Special Use Permit for the new business location. S taff recommends approval of a Special Use Permit for a Planned Unit Development to allow a nutrition counseling office to occupy 319 N. Schmidt Road. 2

SPECIAL USE PERMIT FOR OUTDOOR DINING / TACO DINER, 1196 W. BOUGHTON ROAD, SUITE D / APPLICANT: YELI CORPORATION, ILDA RODRIGUEZ PROJECT NO.: Motion Jacobs, second Campos to open the public hearing. Motion carried, public hearing opened at 8:07 p.m. Planning and Zoning Administrator, Nicole Knapp, presented the request. Ilda Rodriguez from the Yeli Corporation is requesting a Special Use Permit for outdoor dining at 1196 W. Boughton Road, Suite D, which is located in the Two Rivers Shopping Plaza. Knapp stated that this time, the applicant is currently under construction for interior renovations of an existing tenant space in order to operate a carry out restaurant commonly known as Taco Diner and although there is a large existing outdoor dining area located near the subject tenant space, per the lease agreement that particular dining area is for the use of Panera Bread patrons only. Knapp further added that the outdoor dining area would consist of approximately 4 tables with 4 seats at each table and would be used weather permitting. Hours of operation would coincide with the restaurant, which would be 10:00 a.m. to 9:00 p.m. Sunday through Thursday and 10:00 a.m. to 10:00 p.m. on Friday and Saturday. Per the attached sketch, the 4 tables would be placed near the west side of the space. At the request of the Fire Department, all tables and chairs must be located opposite of the front door, a minimum of 10 feet from the front door while also leaving a walkway area along the curb adjacent to the parking lot. Staff recommends approval of a Special Use Permit for an outdoor dining area at Taco Diner located at 1196 W. Boughton Road, Suite D, subject to the location as approved by the Fire Department. 4 Motion carried, public hearing closed at 8:09 p.m. Motion Wright, second Jacobs to accept the recommendation of Planning Staff. NEW BUSINES S FINAL PLAT OF RESUBDIVISION / PROMENADE BOLINGBROOK PHASE 4 NO. 4 SOUTHEAST CORNER JANES AVENUE AND FALCONRIDGE WAY APPLICANT: TARGET / PROJECT NO.: E Planning and Zoning Administrator, Nicole Knapp, presented the request. Knapp stated that the subject site is zoned B-2 Community Retail, is Part of The Promenade Bolingbrook Phase 4 and that the site is impressed with a Rezoning, Special Use Permit for a Planned Commercial Development with Variances, Preliminary Development Plan and Preliminary Plat from February 2007, including a minor amendment approved in February 2008 to accommodate slight modifications to the overall shopping center. Knapp further stated that at that time the overall development was subdivided into five (5) lots for the future construction of a 137,000 square foot retail store, five (5) retail/restaurant buildings totaling approximately 176,000 square feet, a 66,000 square foot retail building, a 155 room hotel, and wetland purposes. The Final Plat of Resubdivision would create two (2) lots. The sizes of the proposed lots would be: Lot acres Lot acres Newly dedicated easements for utilities and access would be reviewed and approved under separate cover once preliminary site plans for each lot are determined. Access to each lot would remain from Janes Avenue and/or Falconridge Way. Staff recommends approval of a Final Plat of Resubdivision Promenade Bolingbrook Phase 4 No. 4, subject to the review and approval from the Director of Public Works and Engineering and the Director of Community Development. Chairman questioned the plan or intent of the applicant. Knapp responded that T arget had been approached by a large retail, whose name could not be disclosed, and that Target was planning to sell their current lot immediately adjacent to I-355 and that Target would then purchase Lot 1 adjacent to Janes Avenue. Chairman further questioned if Target planned to build a store as part of this development and how close the store would be from the residential area. Knapp explained that the property would remain zoned B-2 Community Retail; however, any previous approvals for setback, parking and/or sign variances would be recinded and that prior to construction Target and any other users in the development would have to go through any necessary amendments to the Special Use Permit for a Planned Development in order to build. The setback along the south property line adjacent to the water tower site would be thirty (30) feet wide and would include a five (5) to six (6) foot high landscape berm, as was previously required, and then a main 4

5 thirty (30) foot wide drive aisle before any building wall would be built. Chairman questioned if a public hearing would be required and Knapp responded affirmatively. Motion Jacobs, second Rashid to accept the recommendation of Planning Staff. OLD BUSINESS APPROVAL OF PLAN COMMISSION REPORTS Motion Wright, second Campos to accept Plan Commission reports: PC10.26 Approval of a Special Use Permit for a Liquor Store, Binny s Beverage Depot 639 E. Boughton Road, Applicant: R.T. Milord Company, Project No.: Voice Vote: Unanimous.
