Approved by a vote of 4 to ENGINEER REPORT: Ellis Pump Station - review letter was issued by MacCombie. Dunwoody status update provided. Lyman Perry, 311 N. Newtown Street Rd. Madsen submitted plans with 2 connections into stub. Then MacCombie was notified by Mr. Perry that Madsen was released from the project. Received a call from Horn Plumbing about grinder pumps. Confirmed payment was received for only 1 EDU. Rafferty Subaru Chapter 95 consistency letter issued. Need Pump and Haul Agreement for 3,000 gallon underground tank for car wash. Tank will be abandoned following connection to public sewer. Liseter need to establish escrow for testing of manhole; need to provide revised as-builts for sewer line and pump station; need to revise easements and legal descriptions. 10. OLD BUSINESS: NONE 11. OPERATIONS MANAGER REPORT: Mr. Nease presented the status report on the RFP for sonic line testing and receipts from the initial quarterly billing. RHM may obtain equipment to test lines sonically. Approximately 600 of 3,500 billing accounts outstanding. 12. NEW BUSINESS: 12.1 Consider approving 4 EDU's at 225 gpd per EDU for 3810 West Chester Pike; the Goddard School, based on water data usage. Cost per EDU is $4, Motion to approve was made by Chairman Sweeney, seconded by Mr. Kay. Approved by a vote of 4 to Consider approving Resolution for assessment of late penalty. Board discussed updated late fee and interest charges. Process would be to send first letter after 30 days overdue saying payment is required in 15 days or Authority will use appropriate means necessary to collect outstanding balance. After 15 days pass without payment, next quarterly bill will show interest and penalty on overdue amount from prior quarter. All collections options were discussed. Motion to approve Resolution was made by Chairman Sweeney, seconded by Mr. Kay. Approved by a vote of 4 to ADJOURNMENT 13.1 Meeting adjourned at 8:02pm. Motion to adjourn was made by Mr. Kay, seconded by Mr. Shrager. Approved by a vote of 4 to 0.

MacComhie, 1I[, Technician Mr. Stephen Nease, Director of Operations Newtown Township Delaware County Municipal Authority 209 Bishop Hollow Road Newtown Square, PA July 28, 2016 Re: Ellis Preserve Town Center _ Sector 1, Phase 3 Multi-Family Section Sanitary Sewer Plan Review Dear Mr. Nease: Please be advisedthat our office has reviewed the revisedset of plans for this project, as received in our office on July 11, It is noted that the engineer s response letter was dated July 1, 2016 and the plan revision dated was June 30, 2016 (revision #4). The revisions have, for the most part, satisfactorily addressedthe issues outlined in our review letter of May 20, 2016 sent to Mr. George Cressman, Jr. P.E. of Bohler Engineers. Aside from some relatively minor technical matters and plan labeling of features, the biggest issue to be resolved is the matter of the operation and maintenance of the sewer lines within the multi-family section. It should be noted that at this point in time the Authority has not rendered a decision upon whether or not they will accept dedication of the collection lines. The applicant has proposed to create an easement for the internal collector lines and dedicate those lines to the Authority for operation and maintenance. While the typical 20 wide easement would generally be acceptable, it is noted that there is a 300 portion of the system _ ranging in depth from 17 to over 21. This portion of the sanitary sewer system is generally situated in front of the club house and Building B. Due to the lines excessive depth, a wider easement width will be necessary to facilitate possiblefuture excavation and repairs. However, due to the proposed placement of other utilities on both sides of the easement, it does not appear possible for a wider easement to be provided. A 25 wide easement is being proposed for the conveyance line around the perimeter of the multi-family section, which will convey the sewage from the townhouse section to the pump station and is not further restricted by other utilities. In regards to the proposed sewer design, the depth of thesewer line appears to be primarily caused by the proposal to run a line at reverse grade, to accommodate the units at the northern end of the project, which are at a lower elevation. There does appear to be the potential
13 The A Page 2 July 28, 2016 Multi-Family Section Sewer Plan review to construct a line between townhouse buildings 100 and 200 to connect to MH 101 for the conveyance line, This could serve townhouse buildings l00 through 400. In addition, the relocation would allow the line serving the multi-family buildings A & B and the clubhouse to be constructed at a more nominal depth. Also, it is requested the applicant s engineer addresses the following matters: Bearings and distances will need to be established for all easements. The l0 wide trail and the grass pavers should also be designed for and identi?ed as a means of access for sewer maintenance vehicles. Should the Authority decide to accept dedication of the collection lines, then legal provisions allowing the Authority the right, but not the obligation, to access the property and to operate, maintain, repair and replace any sewer lines that will be dedicated to the Authority will need to be established by adding the appropriate notes to the plans, as well as incorporate those provisions in the DeVeloper s Agreement and Sewer Agreement. The provisions should clearly stipulate the Authority has the right to use lands adjacent to the permanent easement for construction vehicles and storage of materials, as needed. Club House - as requested. The sewer line serving the club house was changed to be a 6 line, a. Pool discharge quality of the backwash discharge from the pool will need to be addressed during the?ling of the sewer connection permit through the completion of the Industrial Waste Discharge Application. b. Food Service The engineer responded that the club house will not contain - cooking facilities or be providing food service. Therefore, the need for the installation of an outside grease trap does not appear to be warranted. Future Points of connection The engineer responded that inasmuch as the developer has not determined a?nal site layout for the proposed commercial uses on the lands to the south, establishing points of connection for future sewer use is not necessary at this juncture. Friends Meeting House lateral, within an easement from the conveyance line to the pump station has been added to the plans to potentially provide sewer service to this property. Note: the UPN identi?cation information contained on the various plan sheets for this property is actually the identi?cation for the multifamily property and should be relocated accordingly and the correct property identi?cation be added for the Friends Meeting House.
14 The An The Page 3 July 28, 2016 Multi-Family Section Sewer Plan review 7. Labeling & Details It is requested the following information be added or modi?ed on the plans: a. The manholes should be identi?ed on the Grading Plan, sheet 6. b. The through site sanitary sewer easement needs to be delineated by bearings and distances on the Site Plan, sheet 4 and labeled on sheets 4, 5 & 6. It is suggested that either the sanitary and storm manholes be identi?ed on sheet 4 or be removed altogether from that plan sheet. c. The detail provided for deep lateral connections on sheet 17 should be removed. Should any deep lines remain, another detail will be provided. d. The reference to the Ebert plans for pump station on sheet 7should indicate separate design plans, so it is not implied that those plans are part of this set of drawings. Sewer Construction Agreement & Financial Surety required agreements will need to be executed and approved by the NTMA. Fie developer will be required to pay the appropriate tapping fee, which is $ /unit for a total of $2,076, l0. Preliminary Opinion of Probable Costs estimate was provided dated 7/1/16. It is requested that the engineer confirms that the proposed unit costs represent the installation costs for the pipe and manholes and not just the material costs for the products. In addition, costs need to be included for the following: Construction of the laterals from the main to the cleanout and vent trap, Costs for the cleanout/trap & vent Construction layout, Cleaning and testing of the lines As builtdrawings. Please address who will be responsible for the removal of the temporary sewer line to be installed to serve the townhouses until the pond is reconstructed and include the costs if they will be associated with this project.. The estimate needs to contain the 10% for contingencies. The engineering surveillance fee and legal fees associated with the costs of the preparation of the agreements should be provided at 7% of the construction costs. This amount shall be provided to the Township as a cash escrow and is not to be included in the escrow to be provided for the Financial Surety for the Sewer Agreement.

Dear Mr. Nease: Please be advised that our office has completed its review of the revised sanitary sewer design for the proposed townhouses, as contained on the plans dated 6/30/l 6 (Rev. #6). The plans have been revised to address the issues raised in our review of May 18, 2016 sent to Mr. John Baionno, P.E. of ESE Engineering. The onsite sewer design appears to be acceptable and the plans appear to be coordinated with the plans for the multi-family section, in regards to the through site sewer conveyance line to the pump station. The remaining concerns are procedural and administrative. Although the applicant/developer, Toll Brothers is proposing to dedicate the internal sewer lines to the Authority for operation and maintenance, the streets will be private and remain under the ownership of the Condominium Association. Therefore, if the Authority does decide to accept the sewer lines, then legal provisions allowing the Authority the right, but not the obligation, to access the property and to operate, maintain, repair and replace any sewer lines that will be dedicated to the Authority will need to be established by adding the appropriate notes to the plans, as well as incorporate those provisions in the Developer s Agreement and Sewer Agreement. The provisions should clearly stipulate the Authority has the right to use lands adjacent to the permanent easement for constructionvehicles and storage of materials, as needed. It should be noted that at this point in time, it is our understanding that, the Authority has not rendered a decision upon whether or not they will accept dedication of the collection lines. All easements will need to be established by bearings and distances and legal descriptions submitted for review. Another matter that needs to be resolved involves the construction of the off-site conveyance line and the pump station on the BPG property. In particular, the removal of the temporary section of line around the existing storm water management pond needs to be addressed. Those easements will need to be established either by the recordation of the plans for multi familysection or through the processing of separate easement agreements, subject to the Authority s Solicitor s approval. The party responsible for the removal of the temporary section
17 Page 2 July29, 20 l 5 Ellis Preserve Town Center Sewer Plan review for T/H s needs to be established, so that those provisions may be incorporated into the Developers and Sewer Agreements and the required escrow is provided by the responsible entity. The required Sewer Construction & Financial Surety Agreements will need to be executed and approved by the NTMA. An Opinion of Probable Costs to support the construction of the sanitary sewer system will need to be provided to establish the?nancial surety. It is requested that there be separate estimates for the on-site sewer and off sitesewer. The tapping fee has been established to be $6,390.00/unit for a total of $485, for the 76 townhome units. Accordingly, the above noted matter regarding who will be responsible for the operation and maintenance of the sewer lines should be resolved before the plans can be finalized and deemed to be acceptable for recordation.
