KUSHAL EDUCATIONAL TRUST - You had availed above mentioned credit facility from Central Bank of India, Kallakurichi Branch. The repayments of the said loans are inter alia secured by mortgage of schedule mentioned properties in the sale notice enclosed. You failed to pay the outstanding to the Bank and therefore you were called upon to pay the outstanding balance amount of Rs. 8,57,39, (Which represents Principal plus Interest charged up to 02/11/2015 and further interest thereon from 03/11/2015), vide our demand notice dated 06/11/2015 issued under Section 13(2) of the Security Interest Act. It was made clear that if the payment is not made within 60 days, Bank will be constrained to exercise its rights by taking possession of the securities. As you failed to make payment, the Authorised Officer took possession of the securities more fully described in the schedule hereunder on 28/01/2016. As per Section 13(4) of the Act, the Bank is entitled to effect sale of the same and realize the proceeds towards costs, charges, expenses and outstanding balance with further interest due thereon. Accordingly, the authorised officer intends selling the secured assets described in the schedule hereunder. The sale is intended to be carried out by Chennai by way of e auction platform provided at the website on such terms and conditions as per the details of the sale notice attached herewith which is forming part of this notice. 6 Terms and conditions 1. The e-auction is being held on AS IS WHERE IS and AS IS WHAT IS BASIS and NO COMPLAINT condition 2. The auction sale will be Online E-Auction/Bidding through website on 26/10/2016 from 11.00AM to NOON 3. Intending bidders shall hold a valid Digital Signature Certificate, address and PAN number. Bidders are required to go through the website for detailed terms and conditions of auction sale before submitting their bids and taking part in the e-auction sale proceedings. 5. To the best of knowledge and information of the Authorized Officer, there is no encumbrance on property affecting the security interest. However, the intending bidders should make their own independent inquiries regarding the encumbrances, title of property put on auction and claims/ rights/ dues/ affecting the property, prior to submitting their bid. The e-auction advertisement does not constitute and will not be deemed to constitute any commitment or any representation of the bank. The property is being sold with all the existing and future encumbrances whether known or unknown to the bank. The Authorised Officer/ Secured Creditor shall not be responsible in any way for any third party claims/ rights/ dues. 6. After Registration by the bidder in the Web Portal, the intending bidder/ purchaser is required to get the copies of the following documents uploaded in the Web Portal before last date of submission of the bid viz. i) Copy of the NEFT/RTGS Challan; ii)copy of PAN Card; iii) Proof of Identification (KYC) viz. self-attested copy of Voter ID Card/ Driving License/ Passport etc. iv)copy of proof of address; without which the bid is liable to be rejected. 10. The interested bidders, who have submitted their bid not below the Reserve Price through online mode before 4:00 PM on 24/10/2016 shall only be eligible for participating the e-bidding process. The e-auction of above properties would be conducted exactly on the scheduled Date & Time as mentioned against each property by way of inter-se bidding amongst the bidders. The bidder shall improve their offer in multiple of the amount mentioned under the column Bid Increase Amount. In case bid is placed in the last 5 minutes of the closing time of the e-auction, the closing time will automatically get extended for 5 minutes (subject to maximum of unlimited extensions of 5 minutes each). The bidder who submits the highest bid amount (not below the Reserve Price) on closure of e-auction process shall be declared as Successful Bidder and a communication to that effect will be issued which shall be subject to approval by the Authorised Officer/Secured Creditor. 11. The Earnest Money Deposit (EMD) of the successful bidder shall be retained towards part sale consideration and the EMD of unsuccessful bidders shall be refunded. The Earnest Money Deposit shall not bear any interest. The successful bidder shall have to deposit 25% of, the auction price less the EMD already paid, within 24 hours of the acceptance of bid price by the Authorised Officer and the balance 75% of the sale price on or before 15th day of sale or within such extended period as agreed upon in writing by and solely at the discretion of the Authorized Officer. If any such extension is allowed, the amount deposited by the successful bidder shall not carry any interest. In case of default in payment by the highest and successful bidder, the amount already deposited by the bidder shall be liable to be forfeited and property shall be put to re-auction and the defaulting bidder shall have no claim/ right in respect of property/ amount. 12. The authorized Officer is not bound to accept the highest offer and the authorized officer has absolute right to accept or reject any or all offer(s) or adjourn/postpone/cancel the e auction without assigning any reason thereof. 13.
