6 SPECIAL CONDITIONS 1) Save where the context otherwise requires or implies or the text hereof expresses to the contrary, the definitions and provision as to interpretation set forth in the within General Conditions shall be applied for the purposes of these Special Conditions. 2) The said General Conditions shall: a) apply to the sale insofar as the same are not hereby altered or varied and these Special Conditions shall prevail in case of any conflict between them and the General Conditions, b) be read and construed without regard to any amendment therein, unless such amendment shall be referred to specifically in these Special Conditions. 3) The Title will consist of Folio 4001 of the Registrar of Freeholders County Dublin and shall be deduced from that. 4) Included in the contract price are the fitted carpets, curtains and light fittings presently in the property. These items are valued at *. 5) The vendor is selling in his capacity as personal representative of the estate of John Francis Cullen who is legal owner of one undivided ½ share. The Vendor is also selling in his capacity as full owner as tenant in common of the other undivided ½ share. 6) The Purchaser is deemed to purchase the property with full knowledge of the actual state and condition of same and to take the property as it stands subject to all rights of way, water, light, drainage and other rights and privileges that might affect same. 7) The Purchaser is deemed to have inspected the property and to be familiar with its boundaries, fences and walls and shall not require any Declaration of Identity or explanation as to boundaries, fences and walls save and except for that already furnished. No requisition or objection shall be raised in respect of same. 8) On the exchange of contracts, the Vendor s solicitor shall send to the Purchaser s solicitor the CORT system of objections and requisitions on title with replies endorsed. General condition 17 will then apply to the replies of the Vendor and to any objection, further requisition or rejoinder the Purchaser s solicitor wishes to raise. 9) The Vendor shall discharge all local property tax relating to the subject property in advance of the completion of the sale and furnish the Purchaser with confirmation of payment on completion of the sale. The amount paid by the vendor in respect of local property tax relating to the subject Property shall be apportioned as between the Vendor and the Purchaser in accordance with the provision of General Condition 27. General Condition 8 (c) and General Condition 27 are amended accordingly.
