Delegations a) TES-TRS-18-05, Potential Sale of Community CarShare to a For-Profit Corporation Recommendations for Regional Parking Licence Agreement and Line of Credit Agreement *B. Vrbanovic entered the meeting at 9:06 a.m. i. Matthew Piggott, Community CarShare made a presentation to Committee regarding the sale of Community CarShare. He provided an update and current status of CarShare. A copy of the presentation is appended to the original minutes.

2 P&W Minutes /01/30 ii. Sondra LaBelle, Communauto/VRTUCAR appeared before the Committee to answer any questions and to ensure that Carshare will continue in this community. The delegations provided clarification regarding current memberships, fleet size and parking spaces. Moved by B. Vrbanovic Seconded by K. Redman That the Regional Municipality of Waterloo authorize the assignment and amendment of the Region s existing Parking Licence Agreement and the assignment of the Line of Credit Agreement with Community CarShare Co-Operative Inc. o/a Community CarShare, to Virtue Transportation Systems Incorporated (VRTUCAR), to the satisfaction of the Regional Solicitor, and authorize the Commissioner of Transportation and Environmental Services to execute all necessary documentation for such assignments and amendments. Carried b) TES-DCS-18-02, Class Environmental Assessment Study- Highland Road Improvements, Fischer-Hallman Road to Ira Needles Boulevard, City of Kitchener *S. Foxton and S. Shantz entered the meeting at 9:15 a.m. i. Katherine Serwin appeared before the Committee stating she resides on Michelle Crt. She highlighted that she is asking for a noise barrier wall to be installed for the 5 houses on Michelle Crt. that back onto Highland Road. She highlighted that the noise has increased over the past several years as cars connect to Ira Needles Blvd from Highland Road. She asked the Region to conduct live noise assessments during peak times at the Highland Road and West Forest Trail intersection to accurately measure noise levels. She stated that a precedent has been set, noise barrier walls already exist on Highland Road East and feels residents on Michelle Crt are entitled to them as well. She also noted that a noise barrier wall would provide privacy since the multiuse trail will be within 1 meter from her property line. ii. Lindsay Markle appeared before Committee a resident from Michelle Crt. He highlighted three major concerns with the Highland Road improvements; noise, speed including traffic calming and the increased lanes. He stated that the noise report is from 1999 and needs to be updated. He highlighted

3 P&W Minutes /01/30 that he conducted his own sound measurements with a sound meter and was measuring noise at over 85 decibels on a normal day which is over the threshold. He asked that actual noise measurements be taken and for the Region to take the extra step above the guidelines to do more. He stated there is very little congestion along Highland Road and doesn t feel the need for 4 lanes and pointed out that 4 lanes will likely increase the speed. He concluded his presentation asking for a noise barrier wall and to reconsider the 4 lanes. Chair T. Galloway made a call for additional delegations. iii. Nancy Kingsley appeared before Committee stating she lives at 1413 Highland Road. She highlighted that her house is the only house that fronts onto Highland Road and has been there since She stated that she doesn t have sound proofing and can verify what the previous delegations are saying about extreme noise. She highlighted that she doesn t want to see the two mature trees removed from her front yard. She expressed concerns about visibility issues, the center median preventing left turns out of her property and asked for landscaping front of her house to protect it from any potential collisions. William Gilbert, Senior Project Manager stated that he has spoken with the delegation about moving the multi-use trail closer to the road to potentially allow for the mature trees to stay and that the center median in front of 1413 Highland Road will include a left turn access. W. Gilbert provided a presentation to Committee that highlighted the Project Context, Project Limit, Existing Condition, Recommended Design, Noise Policies, Noise Objectives/Criteria Part A, Part B, and Part C, and Next Steps. A copy of the presentation is appended to the original minutes. Chair T. Galloway sought clarification on the existing berm on Michelle Court and if a noise wall be installed where would it be located. B. Gilbert stated that the developer installed the berm and that the noise wall would be installed on Regional property in front of the berm. Committee members pointed out the noise policy is 17 years old and asked if there are plans for it to be updated. W. Gilbert stated that he is not aware of any initiatives from the Province with respect to revising its modeling. Steve van De Keere, Director, Transportation, highlighted that roughly 10 years ago the Region did some field testing to look at actual measurements to compare them to the levels that would be generated by the modeling and they found that the model does an accurate job of representing those average noise levels.

4 P&W Minutes /01/30 Clarification was provided on the noise modeling stating that the modeling is not test based it is based on certain criteria; traffic on the road, elevation, distance of set backs, development in the area and future development. The model asks to use a 10 year projection in traffic and staff used a greater projection based on the Region s Official Plan numbers and the modeling doesn t anticipate significant noise increase in the near future. Committee members discussed lighting, fencing along Highland Road, traffic calming, elevation of the road, cost of installing a noise barrier, the need for active transportation, and design features. Committee members asked that staff look at reviewing the noise policy and to establish an ad hoc Committee to review the policy and asked how long that review would take. Staff stated they could provide a full review of the policy and could take until 2019 before staff could report back. A Committee member asked that an amendment be made to the recommendation to include a review for additional noise mitigation one year after completion of the road improvements, review the current noise policy and to approve a noise wall for the 5 residents on Michelle Court that back onto Highland Road. A Committee member cautioned approving a noise wall stating that the Region has policy in place to provide equal treatment for all Regional residents and asked not to approve one offs until the policy is reviewed. A recorded vote was requested and that the recommendations be taken separately. Moved by G. Lorentz Seconded by B. Vrbanovic c) Direct staff to undertake a review of the need for noise mitigation, in accordance with Regional Implementation Guideline for Noise Policies, one year after completion of construction of road improvements on Highland Road from Fischer-Hallman Road to Needles Boulevard. And further, d) Direct staff to report back on previous Regional Council reviews of the Regional Implementation Guideline for Noise Policies, to provide information for Regional Councils consideration of the need for a comprehensive review of this Guideline. Carried, unanimously b) TES-DCS-18-03, Class Environmental Assessment Study - Highway 7/8 Cycling and Pedestrian Bridge, Chandler Drive to Avalon Place, City of Kitchener i. Zyg Janecki, City of Kitchener Ward 8 Councillor appeared before the Committee representing the residents of Avalon Place. He highlighted that no residents in that area requested a bridge. He stated that about 50% of the comments support the project while the other half don t and feel it is a waste of tax payers money and will increase crime in Avalon Area. He expressed concerns with funding for the project and lack of transit users in that area explaining that service was eliminated in that area because of low ridership. He suggested that the

6 P&W Minutes /01/30 recommendation be turned down and a pedestrian bridge be built for the residents on Traynor Avenue to connect to Fairway Road to resolve the issues there. ii. Gord Schilter appeared before Committee stating he lives at 86 Avalon Place directly across from the proposed bridge ramp. He highlighted that he spoke with all the homeowners on Avalon and no one is in support of the project and that residents raised concerns about the devaluation of their property. A Committee member asked why staff is recommending a pedestrian bridge there. S. van De Keere stated that with the elimination of the bus service in the Avalon area this bridge would provide access to bus service as well as encourage more active transportation. A Committee member expressed the need for the bridge to connect neighbourhoods, improve bus service; encourage active transportation as well stated that this project is about vision. Committee members discussed the need throughout the Region to connect neighbourhoods that would encourage more walkable and sustainable communities. Some Committee members inquired about the design of the bridge and highlighted the bridge needs to be esthetically pleasing. A suggestion was made to include public art to the bridge as well. Committee members sought clarification on the financial information regarding funding and the project moving forward. Mike Murray, Chief Administrative Officer, stated that the recommendation is to proceed with filing the EA and since there is funding in place to proceed with the detailed design. Staff will include this project in the list of projects for transit phase two funding and bring back a report before going to tender. He highlighted that a number of staff met with Provincial staff to talk about the evolving transit infrastructure for funding phase two and this project would meet their eligibility criteria. Clarke That the Regional Municipality of Waterloo: a) approve the Recommended Design Alternative for the Highway 7/8 Cycling and Pedestrian Bridge between Chandler Drive and Avalon Place, in the City of Kitchener, as outlined in Report TES-DCS-18-03; and

7 P&W Minutes /01/30 b) direct staff to file the Notice of Completion for this Class Environmental Assessment Study by means of advertisements in local newspapers and mailings to adjacent property owners, tenants and agencies, and place the Environmental Study Report on public record for a period of thirty (30) days. Part of Lot 3 S/S King Street & W/S Potter Street Plan 521, being Part 6 on 58R-18877, Part of PIN (LT), ( Queenston Rd, And that staff be instructed to register a Plan of Expropriation for the property within three months of the granting of the approval to expropriate the property, as required by the Expropriations Act; And that the registered owners be served with a Notice of Expropriation and a Notice of Possession for the property after the registration of the Plan of Expropriation and the Regional Solicitor is authorized to take any and all actions required to enforce such Notices including but not limited to any application pursuant to Section 40 of the Expropriations Act; And that the Regional Solicitor is authorized to enter into an agreement with the registered owners, or to make an application under Section 39 of the Expropriations Act, to adjust the date for possession specified in the Notice of Possession as may be required; And that all above-referenced fee simple partial takings situated adjacent to an existing Regional public highway be acquired for road widening purposes and therefore be deemed to form part of the adjacent public highway in accordance with subsection 31(6) of the Municipal Act, 2001; And that if no agreement as to compensation is made with an owner, the statutory Offer of Compensation and payment be served upon the registered owners of the property in the amount of the market value of the interests in the land as estimated by the Region s appraiser in accordance with the Expropriations Act; And that the Regional Solicitor be authorized to execute any Indemnity agreement or other document related to payment of the statutory Offer of Compensation; And further that the Regional Solicitor be authorized to discontinue expropriation proceedings or any part thereof, in respect of the above described lands, or any part thereof, upon the registration on title of the required documentation to complete the transaction or if determined by the Commissioner of Transportation

That The Regional Municipality of Waterloo direct and authorize the Regional Solicitor to take the following actions with respect to the expropriation of lands for the proposed improvements to King Street (Regional Road No. 8) from Bishop Street to Eagle Street in the City of Cambridge in the Regional Municipality of Waterloo as detailed in report PDL-LEG dated January 30, 2018: 1. S. van De Keere highlighted that the Region has a landscaping policy to look at treatments in the islands of roundabouts. He stated that staff considers the safety aspect of art and to have a fixed object is not desirable as the only fatalities in a roundabout are vehicles striking fixed objects. Between Westforest Trail and Ira Needles Boulevard, the forecasted 65 dba free-field limit encroaches onto adjacent residential properties, however, the houses are sufficiently set back from the rear property line and noise levels at the Outdoor Living Area will be below 65 dba (without consideration of the existing noise berm that would further reduce noise levels) Based on the Regions Noise Policies and the results of the noise modeling and analysis, no noise mitigation has been identified as required. 30 Wednesday, January 17, 2018 RE: Carsharing in Waterloo Region To the members of Cambridge, Kitchener, Waterloo, and Region of Waterloo councils, The three cities and the Region are all strong supporters and partners of ClimateActionWR, a collaboration between local organizations and community members who championed the development of Waterloo Region s first-ever community action plan on climate change. ClimateActionWR supports the implementation of the Climate Action Plan for Waterloo Region in an effort to achieve a community-wide greenhouse gas reduction target of 6% by In May of 2017, ClimateActionWR released a report entitled Our Progress, Our Path. The report revealed that Waterloo Region has taken substantial steps towards its short-term greenhouse gas reduction target, with the region achieving a 5.2% reduction in greenhouse gas emissions between 2010 and Despite this progress, the report also highlights a growing concern for Waterloo Region. Transportation emissions grew at a rate of 5% between 2010 and 2015, and now make up 49% of the region s greenhouse gas emissions. At the same time, vehicle ownership in Waterloo Region grew at twice the rate of population growth. These findings highlight that we must continue to work to provide low-carbon transportation options in Waterloo Region. We believe that carsharing is part of the solution for this problem. A Climate Action Plan for Waterloo Region, approved by councils in 2013, identifies carsharing as one of its initiatives to reduce our community s greenhouse gas emissions. The Climate Action Plan includes, as noted on page 77, Expand[ing] privately-operated shared vehicle systems, such as Community CarShare, to provide alternatives/supplements to personal vehicle ownership. Community CarShare was the original and only privately-operated shared vehicle system at the time of the plan's development, and Community CarShare is currently undergoing a structural and ownership change. As ClimateActionWR continues to work with partners and organizations across Waterloo Region to meet our 2020 goals, and looks ahead to setting a 2050 emissions reduction target, carsharing will continue to be an important part of building diverse and sustainable transportation options in Waterloo Region. It is crucial that reliable carsharing services continue to be available to residents and businesses in the region over the coming years.
