1 11/23/10 Regular Trustees Meeting Zoning Inspector Report 1. Zoning Approvals: a. None 2. Zoning Compliance: a. 10/14/10 - Contacted Tim Shetter / Metroparks for update on building removal from 4150 S Berkey Southern; i. Contract for removal of buildings was re-written for 3 rd time to include removal of buildings on other properties; ii. Contract has been signed with contractor, 4150 S Berkey Southern will be a priority for earliest building removal. b. Melvin Spencer, 6335 Jeffers; i. 8/31/10 - Wrote to John Borell asking if a notice placed in a newspaper of general circulation would constitute serving of Trustee notice of possible action on junk vehicles in yard; ii. 9/2/10 - John's response: "Yes, you must publish it in a newspaper of general circulation(blade or Legal News) AND post the notice on the main structure located on the property." iii. 10/8/10 - Legal notice provided to Trustees for action at 10/12/10 regular meeting; iv. 10/26/10 - Field report including pictures provided to Trustees. v. 11/3/10 - Requested legal opinion from John Borell re: entering private property to take pictures to develop a case to allow Trustees to remove junk vehicles; 1. 11/5/10 - John Borell asked if entering property was only way of obtaining pictures, responded that is was /8/10 -John Borell issued legal opinion - "This will confirm our telephone conference regarding entering a property to take pictures of junk cars. It is my suggestion that you ask permission of the property owners if someone is home. If permission is denied, do not enter the property. However, I understand that it appears that no one is living on the property on a regular basis. If no one is home, take the pictures from the driveway." c. Towner Property, Archbold Whitehouse Road; i. I called various scrappers in the area to see if any might be able to help Mrs. Towner remove the house trailer, here are the results: 1. 9/7/10 - No additional information or progress. 2. 9/29/10-10/5/10 - Multiple attempts to contact for update, no response; 3. 10/8/10 - Zoning violation mailed /18/10 - Mrs. Towner came to Zoning Commission meeting, discussion about what options she had, suggested she come to Trustees meeting 10/26/10 and tell Trustees what she was able to commit to and seek direction from Trustees.
2 5. 10/26/10 - Ms. Towner spoke to Trustees about current situation, that person has been hired to dismantle and remove one trailer but requires surgery and recovery prior to starting work, other trailer cannot be removed until new building is erected for material being stored inside; a. Trustees stated Ms. Towner should contact Zoning Inspector on a regular basis to update progress. d. 9/2/10 - Complaint on burned out house at 4647 S. Berkey Southern relayed by Trustee Tippie; i. 9/3/10 - Owners are Lester and Judith Sparks, not current phone listing or address, property taxes have not been paid in over 18 months; ii. 9/7 /10 - Google search does not provide any information on owners. iii. 9/20/10 - Mailed first class letter asking for contact to speak about potential zoning violation; iv. 9/26/10 - No response yet, will send certified letter. v. 10/9/10 - Certified letter sent vi. 10/18/10 - Received USPSconfirmation certified letter was accepted at address delivered to, no response from owners of record. vii. 10/25/10 - Called by Randy Sparks, son of owners, stated his parents intended to remove the house, but were not financially able to do so at this time; 1. Mr. Sparks was told that a zoning violation will probably be issued, his contact and information were appreciated. 3. Zoning Request a. 11/1/10 - Walters Travel Trailer, Airport Hwy., new sign; i. 11/1/10 - Called by Harmon Sign for updated sign zoning, Walters Travel Trailers intending on installing message center sign; ii. 11/2/10 - Provided by complete current text of township zoning resolution sign language. b. 11/11/10 - Realtor Deanna Miller called re: 2741 Scott Road, prospective buyer asking if pond could be put on property; i. Provided Swanton Twp Zoning Resolution (a) which requires minimum of 5 acres for pond on property, this property is 4.17 acres, pond not allowed. c. 11/17/10 - Ohio State Extension Service at Toledo Botanical Gardens; i. Updating zoning information for area townships regulating small domesticated animals, such as chickens, rabbits, etc. ii. 11/18/10 - Informed Extension Service that Swanton Township does regulate small domesticated animals for personal use, only for commercial or recreational use as defined in Swanton Twp. Zoning Resolution section /16/10 - Trustee request - BZA mock hearing a. Trustee Tippie requested a mock hearing for the BZA so members could experience what a hearing would entail; i. Thanks to Trustee Irmen, Sandy Bucher and Trustee Tippee for participating, mock hearing went well.

Trustee Tippie requsted mock Trustee request BZA mock hearing for BZA to give members N/A N/A hearing experience with how a hearing would proceed and BZA responsibilities. For: Walters Harmon Sign Travel Trailers, Airport Hwy. Walters Travel Trailers 11/1/10 - Harmon Sign requested current sign zoning, Walters Travel Trailers will be erecting message center sign in near future. 11/2/10 - ed complete text from Twp Zoning Resolution to Harmon Sign and discussed Twp. zoning requirements. In process 11/2/10.

Certified letter asking for contact mailed. 10/18/10 10/9/ Received from USPS acceptance card for certified letter delivered to 4661 S Berkey Southern. 10/22/10 - No response. 10/25/10 - Call from Randy Sparks (son) stating parents intended on removing house, but did not have financial means to proceed. Mr. Sparks told a zoning violation would most likely be issued. In process 10/25/10. New contract will be awarded at Metroparks Metroparks Metro parks 4150 S. In process 10/14/10. Attempted to contact multiple times by phone for update 9/29/10 Zoning violation Towner Property Archbold Whitehouse Road Melvin & Susan Towner mailed 10/8/10. Commission meeting 10/18/10, Zoning request for modular home to replace mobile home. discussed the zoning violation. Suggested that she attend the Trustees meeting on 10/26/10 bring property into compliance. - 10/5/10. Mrs. Towner and son attended Zoning 10/26/10 and present a reasonable plan to - Ms. Towner attended Trustees meeting, Trustees said as long as there was progress toward a plan to become compliant they would be satisfied and that she should update Zoning Inspector regularly. In process 10/26/10.

No phone number listed for owner Melvin Spencer, house appears to be vacant. 8/23/10 - Certified letter returned by USPSafter 15 days of attempting to deliver. 8/30/10 - Sent to John Borell asking if legal notice in newspaper of general circulation would constitute being served by Trustees. 9/2/10 - John's response: "Yes, you must publish it in a newspaper of general circulation(blade or Legal News} AND post the notice on the main structure located on the property." 10/4/10 - Inspected property again, talked to neighbor, Mr. Spencer has been at property "several times" recently, but is apparently living elsewhere. Inventoried vehicles for legal notice. 10/26/10 - Presented field report including pictures of vehicles in question to Trustees. 11/3/10 - Requested legal opinion from John Borell if it is legal to enter private property to take photographs for junk vehicles to build case for Trustee removal. 11/5/10 - Borell asked if property was vacant, responded that owner is in the area, but not living at property. 11/8/10 - John Borell's legal opinion - "This will confirm our telephone conference regarding entering a property to take pictures of junk cars. It is my suggestion that you ask permission of the property owners if someone is home. If permission is denied, do not enter the property. If no one is home, take the pictures from the driveway." 11/15/10 - Joe Zielinski offered to assist Zoning Inspector in obtaining phtographs of junk vehicles. In process 11/15/10.
6 Road Superintendent Report for November 7, 2010 thru November 20, 2010 Prepared by Kenneth A. Biller Road Superintendent/Cemetery Sexton November 8,2010 Checked and picked up cemetery. Pushed brush back on Soul Rd. Put down berm on Co. Line. Checked all roads and removed dead animals on Co. Line and Reed Rd. Worked with Delores on the cemetery records. November 9, 2010 Put down berm on Co. Line, Manore, Reed, Jeffers, and Girdham Rds. Did road side mowing on WilkinsRd. Cleaned Town Hall windows and floor. Swept bathrooms and shop office. Put cold patch on Co. Line, Reed, and Girdham Rds. Washed 1-ton. November 10, 2010 Met with Nix Electric to get started wiring the cemetery building. Met with Ron Meyer from the County about the new signs. Helped Providence Twp. with some berming. Put down berm on Girdham Rd. Did road side mowing on Reed Rd. Worked with Delores on the cemetery records. November 11, 2010 Holiday. I worked because the electricians were working on the cemetery wiring. Straightened cemetery stones. Worked on cemetery records with Delores. Helped to relocate meter base. November 12, 2010 Dug trench thru concrete fill in the cemetery for the electric wire to the building. Did road side mowing on E. Reed. Put down berm on Jeffers Rd. Worked on cemetery records with Delores. November 15, 2010 Worked on moving the concrete fill in the cemetery. Hauled dirt from the Manore Rd. facility to back fill the trench in the cemetery. Did pay roll. Got keys made for the cemetery office in the Town Hall. November 16,2010 Doctors appointment in the morning. Hauled dirt from the Manore Rd. facility to back fill trench in the cemetery. Met with two different families to locate graves in the cemetery. Worked on the cemetery records with Delores. November 17, 2010 Picked up brush that blew down in the cemetery. Worked on the cemetery records with Delores. Met with Patti from the Edison about the hook up in the
7 cemetery. My wife Connie came to the office and built a program so that we can enter all of the burials in the cemetery so that we can find all of these with out going thru the owners of the graves. November 18, 2010 Back filled trench in the cemetery where the concrete fill was. Checked Jeffers, Manore, Reed, and Girdham Rds. Picked up down limb on Jeffers Rd. Worked on the cemetery records with Delores. November 19, 2010 Doctors appointment in the moming. Did all of the daily reports. Met with Providence Twp. to make sure to have back up help if J would need them. Checked cemetery, Scott, Shaffer,and Brindley Rds. Cleared dead animal off of Shaffer Rd. Checked on ditch cleaning on Scott Rd. Worked with Delores on the cemetery records.
