2 THIS AGREEMENT is made on Date BETWEEN HEREFORD ALLOTMENT AND LEISURE GARDENERS SOCIETY LIMITED ( the Society ), duly authorised Agent of HEREFORD CITY COUNCIL, ( the Council ) by name of Lettings Secretary of the Society on the one part and Name and address of tenant ( the Tenant ) on the other part whereby the Council agrees to let and the Tenant agrees to hire from the above date the allotment No... in the Register of Allotments at. Site at the rent of. (which includes all rates and taxes) for the remainder of this year. Normally the rent for the full year must be paid by 1 st January each year. A proportion of the rent will be charged for any part of the year over which the tenancy extends. The rent will be subject to periodic review. The Tenancy is subject to the rules which have been agreed by the HALGS Committee (and which may change from time to time with due notice) and in signing this Agreement you agree to the following conditions: Rent: 1. The rent shall be paid yearly in advance on or before 1 st January. If for any reason the rent is not paid by 7 th January the tenancy will be automatically terminated. By paying the amount due you are agreeing to comply with the terms of your tenancy/contract and to any amendment made to the agreement/contract by the Allotment Committee 2. You will not underlet, assign or part with the possession of the allotment or any part of it. To do so invalidates your tenancy. The Plot 3. You must keep the allotment reasonably free of weeds, in a good state of fertility and well cultivated. The plot must be 75% cultivated by the end of May for the production of vegetable or fruit crops for consumption by yourself and family. You are not permitted to sell produce from the allotment. The remaining 25% is allowed for sheds, poultry, greenhouses, composters and other landscaping

Plots must be maintained in a way that does not cause a nuisance to other tenants. a) Paths must be kept free from hazards, kept neat and trimmed, this is any path set out by the Council or the Society. b) Where possible seed heads should be removed before the seed as set. c) Long grass or any items that could harbour slugs or snails should be removed 5. Any children who accompany you may not go onto other plots (unless permitted to by that plot holder) and may not cause a nuisance on the site. You are wholly responsible for their actions. 6. You must close any gates on entry and exit 7. No part of the allotment plot shall be converted to hard standing for a car parking area. 8. You must maintain at least half of any path bordering on the allotment. Paths should be a minimum of 30 inches (76cm) wide 9. You must not cut any timber or other trees on the land belonging to the Council or on any adjoining land belonging to private persons, or take away any mineral gravel, soil, sand or clay. 10. You must not enclose your plot with material other than netting or chicken wire in order to protect your plot from pests. Barbed wire must not be used under any circumstances. 11. You must keep any hedges bordering on the plot properly cut and trimmed 12. No well or pond may be constructed on the plot without permission of the Committee Structures on the Plot 13. Consent must be obtained from the Site Representative before erecting any structure such as shed, greenhouse or polytunnel. Structures must not exceed 6 x If permission is granted a system of guttering must be placed on the roof to collect rainwater in a water butt which must then be securely covered. 15. You must not connect hose pipes to any water tank or water supply provided
4 16. Structures must not interfere with neighbouring plots and should be properly maintained 17. You may not erect a CCTV camera on your plot or any building on the plot. The Environment 18. You must comply with rules set down for bonfires as set out in the Allotment Handbook 19. You must not use the allotment for the storage of rubbish 20. If you use pesticides or insecticides you must take all reasonable care to ensure that wildlife, adjoining plots and crops and water tanks are not adversely affected. You must comply with the regulations under the Control of Pesticides Regulation Act and ensure that empty containers are safely disposed of. Livestock 21. You must not keep any livestock or bees on the allotment without first obtaining the written permission of the Committee. Rules for bee keeping on allotment sites can be supplied upon request. 22. Chickens may be kept on the plot with the permission of the Site Representative as long as they are housed appropriately and securely. When the plot is relinquished fowl houses and runs must be removed or you will be liable for the cost of removal 23. Dogs are not permitted on the sites. Enforcement of the Tenancy 24. You must observe these conditions and any rules and regulations which may be made from time to time by the Society or the Council. Due notice will be given of any changes to the rules or regulations. 25. Please note that officers of the Society or the Council are entitled to enter the sites at any time to inspect the plots. Termination of Tenancy 26. The tenancy will terminate on the half yearly rent day following the death of a tenant.

The tenancy hereby created shall be determined (a)the yearly rent is in arrears for 7 days (b)if it appears that you (the tenant) have not observed the conditions of this agreement without good reason (c)if you reside more than one mile out of the boundary of the City of Hereford unless given permission by the Committee (d)that the tenant shall not make any unfunded allegations against HALGS or its Committee either in writing, verbally or by Social Media. This does not prevent a tenant making a complaint which should first be raised with the Site Representative, if not resolved with HALGS Committee and if still unresolved with the Hereford City Town Clerk, the Hereford City Town Clerk s decision is final and binding on all parties 28. If you are in breach of any part of this agreement you will be sent a letter specifying the breach and asking you to remedy that breach within 14 days. If this is not done and there are no extenuating circumstances you will be sent a second letter specifying the breach and asking you to remedy that breach within 14 days otherwise the tenancy will be terminated. 29. On termination of the tenancy you must clear the allotment of your belongings and crops unless otherwise agreed with the Site Representative and leave the plot clean and free from weeds. 30. If you plant any of the following: (a)fruit trees or fruit bushes (b)strawberry plants (c)asparagus, rhubarb or other crops which continue to be productive for two or more years you must remove these on termination of the tenancy unless otherwise agreed with the Site Representative Please note that neither the Society nor the Council will be liable for any compensation claims for any of the above crops Please ensure that you read the accompanying Allotment Handbook and that you notify your Site Representative and the Treasurer of any change of contact details.
