3 KRISTIN OLSON: Good morning everybody. Today is January st. This is the Cabinet Aides meeting for the February th Cabinet meeting, which will be in Tampa. The address is on the Cabinet website, if anyone needs it. We will start at nine. Because we have a request for somebody to go first, I think, Judge Cohen, if you want to go first, if that's okay with everybody, then we will go through the agenda. ADMINISTRATION COMMISSION JUDGE ROBERT COHEN: Thank you, Kristin. Good morning everyone. Bob Cohen, from the Division of Administrative Hearings. I am on the agenda for the February th meeting to present the fourth quarter performance review standards and the annual performance review, as well as the subjective leadership assessment, which has been provided to you and I will present at the meeting next Thursday. I'm happy to answer any questions today. My intention is to quickly run through our compliance with the performance standards, and then give an overview of where we are, what we are doing, and where we see ourselves going in the coming year. I certainly can go into as much detail as you want C & N REPORTERS TALLAHASSEE,FLORIDA 0--

4 today, but I know you usually don't want so much today. And, I also have a : appointment with the CFO, who requested that meeting. BROOKE MCKNIGHT: Judge Cohen, I have just one question. Do you anticipate making any changes to the performance measures moving forward? JUDGE ROBERT COHEN: Well, we have set the performance measures pretty high in terms of the percentages there. I know that Commissioner Putnam likes to see performance measures that are difficult to achieve. And, when you set things in the 0 to percent range, for a lot of them, it's hard to say, okay, we can push it up to percent. But, there are always outliers. Part of our performance is about getting cases scheduled, getting cases through the system and into DOAH and out of DOAH, with a resolution in a timely manner. But, there are always outliers. I mean, there are cases where the parties need a lot more time than even the statute generally gives them, but they agree to additional time. So having outliers like that, of course the vast majority we can move through the system, but those big complex cases that go on and on, and may have an appeal and then come back to us, make it hard to set C & N REPORTERS TALLAHASSEE,FLORIDA 0--

5 performance measures too much higher. We can certainly add additional ones, if there are any suggestions for those, but I think we are-- what we look at is scheduling, getting the case to hearing, getting the Order out from the judge post-hearing, which moves the case on to the next level, whether it's to the Agency for entry of a Final Order, or a direct appeal to a District Court of Appeal. BROOKE MCKNIGHT: I would just-- as you mentioned, Commissioner Putnam obviously wants to see agencies challenge themselves. Fives are great, obviously, and that's a reflection of the team you have in place. Would you say if there is an opportunity to even challenge your team more, whatever that might look like? I know a lot of the agencies have done that, and taken on that. And, some of them only hit threes, some of them fours. I think he refers to them as stretch goals. So, if you feel good about where you are at, that's great. But, just want to make sure that we had the conversation. JUDGE ROBERT COHEN: Sure. Just so it's clear, internally we have a lot of performance measures that aren't looked at because you are looking at the agency as a whole, which is really looking at the judges and the moving of cases through the system. 6 We have very strict performance measures on the folks in the clerk's office, in terms of error rates, and in terms of documents coming into the system. And, their evaluations, semi-annually, are based upon those performance measures internally. I can certainly provide those so you can see how harsh some of them are, because you don't want mistakes made because if something comes in, and it ends up in the wrong case, and the parties aren't on notice of an action, it means something. And, it also gives us something to evaluate our administrative staff with. BROOKE MCKNIGHT: Thank you. JUDGE ROBERT COHEN: Sure. Any other questions? KRISTIN OLSON: I think we're good. 7 KRISTIN OLSON: All right. Next up is Highway Safety. HIGHWAY SAFETY AND MOTOR VEHICLES JENNIFER LANGSTON: Good morning. Highway Safety has two agenda items for your consideration. Item one is actually a combination of two cabinet meeting minutes, transcripts. We are seeking approval for that. And, the second item is seeking approval of our second quarter performance report. Happy to answer any questions. ERIN SUMPTER: Could you run through some of your highlights of-- JENNIFER LANGSTON: Sure. Absolutely. I have Larry Gowen here, also. He is the chief performance officer, and he is able to answer any questions you have. Just a few highlights of mention: performance measure number one is percent of calls for service with FHP. We did see a little dip there, but due to the storms that we had going on, and also other events that we were working, we did kind of anticipate the response time maybe dipping a little bit there, so that is of interest and something we are keeping our eye on, and we expect that to be an increase for next quarter as C & N REPORTERS TALLAHASSEE,FLORIDA 0--

8 well. Also of note would be performance measure number three. That is one of our newly established measures, and the second time bringing that forward, and kind of speaks to the dialogue that just happened. Even though you do see 0 percent there, it doesn't tell the complete story. Director Rhodes would be happy to share some of the stories and good things that we are seeing as a result of our change in that measure. So, it does say 0 percent there, but it's also what we are finding in that measure that she would like to speak to as well. Is that acceptable? ERIN SUMPTER: Thank you. 9 KRISTIN OLSON: Next up is Financial Regulation. OFFICE OF FINANCIAL REGULATION KRISTIN OLSON: Morning, Jamie. JAMIE MONGIOVI: Good morning. Jamie Mongiovi, with the Office of Financial Regulation. The agency has two items on the agenda for the February th meeting of the Financial Services Commission. Agenda item number one, we respectfully request approval of the meeting minutes for November th and December th, meetings. Agenda item number two, the OFR is going to present the agency's quarterly report covering October through December of. Our overall agency score in this quarter was., which equates to meeting expectations. I'm happy to answer any questions, or take you through some of the highlights of that report. ERIN SUMPTER: Please. JAMIE MONGIOVI: Okay. Great. For measures number one through three, which are statutory measures, we scored a five in this quarter. On measure four, which is-- actually, measures four and five are new measures for us. So, this is the second quarter that we are looking at our newly C & N REPORTERS TALLAHASSEE,FLORIDA 0--

10 approved measures from. So, measure four, which measures the average number of days in the Division of Consumer Finance from receipt of applications to approval, we had-- that took us an average of days this quarter, which is a two. So, this is a slight decrease, but we did have some staffing issues this quarter. We also had application volumes that if you look at the same quarter from a previous year there was percent increase in the applications we actually received. So, our staff, you know, certainly tries to handle those as quickly as possible, but this quarter we stored a two. Measure number five, the Division of Securities; same type of measure, the average number of days from receipt of application to the date of approval. We scored a three, and did that in an average of five days. Measure six, which is also a new measure; it's our OFR Employee Engagement Rate. This is an annual measure, and so we are currently at percent. We just sent out the employee engagement survey to our employees, so we would expect to be able to update this percentage in our next quarterly report. Measure number seven is the percentage of financial institutions rating OFR high-performing. C & N REPORTERS TALLAHASSEE,FLORIDA 0--

11 This is also an annual measure. We scored a five for quarter two, and that's percent. Measure number eight, which is also a new measure for us; the average number of days to issue deficiency letters to OFR applicants, and this is the total number of OFR applicants. In our previous measures, we were just looking at Securities, so this looks at everyone. We did that in an average of four days, which equates to a four for this quarter. Measure number nine, which is also a new measure; the percentage of OFR customer calls with a wait time of two minutes or less, and we scored a four in this quarter, which is percent. 12 agenda. KRISTIN OLSON: And, the last is Board of Trustees BOARD OF TRUSTEES OF THE INTERNAL IMPROVEMENT TRUST FUND. RENE LEWIS: Good morning. Rene Lewis, Department of Environmental Protection. There are eight items on the Board of Trustees' agenda for February th. Item one is minutes from the December Governor and Cabinet meeting. Item two is a request for a modification to a year sovereignty submerged land lease to authorize the use of the existing wet slips and a decrease in the preempted area by 0 square feet for an existing commercial docking facility. The applicant is Freeman & Hasselwander Resort Properties, doing business as Tarpon Point Marina. The lease modification was noticed to two property owners, as well as Save the Manatee Club, and no objections were received. Item three is a determination that it is in the public interest to allow non-water dependent activities to be conducted on approximately square feet of sovereignty submerged lands leased by William Semmer, who is doing business as Bonita Bill's Waterfront C & N REPORTERS TALLAHASSEE,FLORIDA 0--

13 Cafe'. Per rule, the consideration for this activity is based on the appraised market rental value of $. per square foot. Item number four is consideration of a request by the City of Witter Springs to exchange a. acre parcel of land for two parcels, totaling approximately 0.-acre of conservation land owned by the Board of Trustees. The Cross Seminole Trail is approximately 0 miles in total and approval of the proposed exchange will complete one of the last remaining segments on the trail. Item number five is consideration of the surplus and sale of approximately. acres of state-owned non-conservation land, in Miami-Dade County. The Department of Corrections requested that the subject parcel be released from its lease. The parcel was marketed and advertised until the bid was opened on January,. The responsive bidder was Natural Vitamins Laboratory Corporation, with an offer of $,0,00. Item six is consideration of the surplus and conveyance of an approximately 0-acre parcel in Miami-Dade County to Cemex Construction Materials C & N REPORTERS TALLAHASSEE,FLORIDA 0--

14 Florida, LLC. Cemex will purchase this parcel for $,,000. Per statute, these funds will be deposited into the State School Trust Fund. This conveyance is in accordance with. Florida Statutes, the Lake Belt Plan. The Department recommends approval, subject to the receipt of the county releasing the lease. And, for our remaining two items we will have Kal Knickerbocker who will present the Division of Aquaculture item, and Lorena Holley will present item number eight. Thank you. KAL KNICKERBOCKER: Good morning. Item number seven is a request to expand the Gulf-Jackson Aquaculture Use Zone. We have received three applications for new bottom leases adjacent to the existing Use Zone. Gulf-Jackson is in Cedar Key, Levy County, in the Big Bend, Seagrasses Aquatic Preserve. We have gone through the review process with our sister agencies, and we have received no comments. The public comment period didn't generate any comments or objections either. And, the Army Corp of Engineers and the National Marine and Fishery Service are all on C & N REPORTERS TALLAHASSEE,FLORIDA 0--

15 board with this action. What we will also ask for is, besides assigning the three leases, is to expand Gulf-Jackson to incorporate these new leases, and we would like to, for consistency sake, put the same authorization to use water column when requested, so that they will be consistent with the other leases in Gulf-Jackson. I am presenting item eight for John Brown. John will be at the Cabinet meeting presenting this item to you guys. Item eight is consideration of the Conservation Easement within the Rural and Family Lands Protection Program over lands lying within the Cannon Family Farm project. It's a -acre proposed easement located in Marion County, within the City of Dunnellon, for a negotiated price of $,. It's the 0 percent of lowest appraised value. It's ranked in Tier One of the Rural and Family Lands Protection Program Acquisition List, and C & N REPORTERS TALLAHASSEE,FLORIDA 0--

16 if approved, it will be the 0th conservation easement with more than,000 acres preserved under the program. The property has been in agricultural production for more than 0 years, and currently maintains a 0-head cow/calf operation, as well as row crop and timber production. The property ranked high due to its hydrological resource benefits and it's located adjacent to lands preserved by the Southwest Florida Water Management District, and contains numerous wetlands. It's also located within the Rainbow River and Crystal Springs Springsheds. I am happy to answer any questions you may have.
