Amend Use Table to clarify that churches smaller than 150 person capacity require a Conditional Use Permit by the Zoning Administrator. (Note: this revision reflects current thresholds for Zoning Administrator vs. Planning review. Please see Section A for required findings for rural institutional uses.) Table 3.1 Industrial Uses A. 3. Surface Mining Revise the hearing authority to Board of Supervisors. Table 3.1 Industrial Uses 4.c. IR zone uses - concrete recycling and other uses Nick Avdis Add provision for Major Recycling Facility in the IR zone with a Conditional Use Permit by the Planning. Private Schools Add footnote: In the Agricultural, Agricultural-Residential, and Residential zoning districts, private schools exceeding 250 students shall require a Conditional Use Permit by the Planning. (Note: the current threshold for Planning review is 100 students.) 1

(Note: the existing Code requires a ZA CUP for indoor recreation under 500 person capacity and a Planning CUP for indoor recreation over 500.) Table 3.1 Commercial Uses C.2 Outdoor Recreation Add footnote to read: In the Agricultural, Agricultural-Residential and Residential zoning districts, outdoor recreational facilities exceeding a 150 person capacity shall require a Conditional Use Permit from the Planning. (Note: the current Code requires a Conditional Use Permit by the Planning Table 3.2.T T.8 Cargo Containers in Residential zones Planning for all outdoor recreational facilities in these zones.) Add one Cargo Container as an Accessory Use in Residential zoning districts with a Minor Use Permit. Amend T.8 as follows: 8. In residential zoning districts, a minor use permit, including design review, is required in order to ensure that the container is designed to be compatible with and complement existing dwellings on the same or adjacent parcels. Table 3.3 J. Short Term Shelter Non-profit organizations A. Modification of Nonconforming Structures Increase the capacity number to 125. Add Modification to Repair and Maintenance of Non-Conforming Structures. (This change clarifies that modifications can be made to non-conforming structures that would not typically be considered repair or maintenance.) Page 2 of 10 2

Room Rental and Vacation Rental, Single-Family Dwelling In residential and mixed use zoning districts, the rental of rooms in any single-family dwelling is permitted for up to two (2) rooms individuals. If more than two (2) individuals rent rooms are rented within the single-family dwelling, a Room Rental Permit by the Planning Director is required. A maximum of five (5) rooms individuals may qualify to rent rooms within any singlefamily dwelling in the residential and mixed use zoning districts, subject to a Room Rental Permit pursuant to the findings in Section A Vacation Rental Permit may be issued pursuant to the findings in Section Page 3 of C.1.b Commercial Solar in Industrial zones Amend the table to indicate that Commercial II Solar types require a Minor Use Permit in the Industrial zones F.6.p. Auto repair in home occupations Add: See guidelines as provided in Section A V.2.a. Multiple lanes in drive-through windows Add: When multiple lanes are provided, the length of each lane may be counted A Parkway Combining Zones maps Replace Exhibits A through D with the attached maps. These maps are digitized to aid in pinpointing properties subject to the PC overlay zone. Signs known as feather flags or banner flags are prohibited. 3
4 Zoning Code Section N.8.b Topic Source Proposed Revision Lighting standard for Digital Billboards Planning Fight the Light ECOS Amend N.8 as follows: b. Illumination. Digital billboards may be internally or externally lit; the light cast through reflection or glare onto surrounding objects, or illuminance, is measured in footcandles. Signs shall not be illuminated at more than 0.3 foot candles above ambient light, as measured using a foot candle meter at a distance of 250 feet from the sign face. Each display must have a light sensing device that will adjust the illuminance of the sign as ambient light conditions change. c. Luminance. Through LED technology, digital billboards directly emit light, or luminance, the intensity of which is measured in nits. Luminance levels shall not exceed 7,500 nits during daylight hours and 300 nits at night. Each display must have a light sensing device that will adjust the luminance of the sign from dawn to dusk N.8.c N.2 Separation of Digital Signs. Fight the Light ECOS Amend K.1 to read: If any on-site digital display exceeds 200 square feet, than the sign must be located at least 500 feet from a residential zone and at least 2500 feet from another on-site or off-site digital sign. Amend N.2. to read: See Sections K.1 and N.8.c for separation requirements for digital sign requirements. Amend N.8.c to read No digital billboard shall be located within 2,500 feet of any other digital billboard or on-site digital sign with over 200 square feet of digital display. Digital billboards shall be located at least 500 feet from a parcel located within any Agricultural, Agricultural Residential, or Residential zone. Page 4 of S. 5 Zoning Code Section H A Topic Source Proposed Revision Sign District and Master Sign Program Community wide interest for CPAC appeal Jim Wiley Add subsection 9: Signs approved as part of a Master Sign Program pursuant to R may be exempt from these provisions. Planning Add the following definition of community-wide interest as a finding for a CPAC appeal: Community-wide interest means that the project could potentially adversely affect properties beyond the immediate neighborhood (properties within 500 feet), in terms of traffic, noise, aesthetics, drainage, or other impacts. In addition, the project would set a precedent for a use of land that has policy implications for the larger community D.1 Title IV Special Development Permits Use of term obsolete in Title IV Nick Avdis Modify language as follows: The appropriate authority may issue a Special Development Permit to allow deviations from any development standard in this Title. Use of the word obsolete to describe the AC, TC, SC zones in Title IV may have a negative connotation. Change the description to Zone Categories No Longer in Use Attachments: 1. 7 Page 7 of S. Special Provisions for Multi-Family Promotional Signs 1. In addition to the signs permitted under A, and notwithstanding any provision in this chapter to the contrary, the following types of signs, in the number indicated, are authorized for multi-family structures: a. Class-A Structures" have at least 3 but not more than 75 living units and are eligible for a permit authorizing the following signs: (i) Up to 12 helium-filled balloons. One yard sign. (iii) One banner. b. "Class-B Structures" have at least 75 but not more than 150 living units and.are eligible for a permit authorizing the following signs: (i) Up to 12 helium-filled balloons. Two yard signs. (iii) Up to two banners. c. "Class-C Structures" have more than 150 living units and are eligible for a permit authorizing the following signs: (i) Up to 12 helium-filled balloons. Up to three portable yard signs. (iii) Up to three banners. 2. Sign Regulations for Multiple Family Structures. a. Helium-filled balloons must meet the following criteria: (i) When inflated, each balloon must fit within a box that has a height, width, and depth of 15 inches (i.e., 15" x 15" x 15"). No Mylar balloons. (iii) No internal illumination. b. Each yard sign, including supports, must fit within a box with a height of not more than 4 feet, a width of not more than 3 feet, and a depth of not more than 3 feet. A-frame signs are prohibited. c. Each banner must meet the following criteria: (i) Its height must be not more than 4 feet, and its width must be not more than 12 feet. It must be securely mounted on a permanent structure that is integral to the multiple family structure, and it must not flap or wave in the wind. Hanging of banners from roof liners, eaves or paraquets is prohibited. Feather flags are prohibited. (iii) It must be composed of retardant materials. d. General. Page 7 of 10
8 (i) Each site much obtain a Temporary Use Permit and pay established fees to cover the cost of issuing the permits, inspecting the signs after installation, and otherwise administering and enforcing this Section. Each permit will be valid for one year from the date of issuance. (iii) If, while a permit is in effect, the permit holder has complied with this section, then the permit holder will be entitled to renew the permit for another year upon payment of the fee in effect at the time of renewal. Otherwise, a permit is not renewable. (iv) The permit holder shall place and maintain each sign so that the sign is not a hazard to vehicular or pedestrian traffic. (v) The permit holder shall place and maintain each sign on the private property where the associated multi- family structure is situated. Signs may not be placed in public rights-of-way. (vi) The permit holder shall maintain each sign in good repair. (vii) While a permit is in effect, the permit holder may repair or replace the associated signs without obtaining a new permit. (viii) The County may remove, without prior notice, any sign that does not comply with this section. If the County removes a non-compliant sign, then the County shall send the permit holder a written notice identifying the reason for removal, the location where the permit holder may retrieve the sign, and the deadline for retrieval (which must be at least 10 days after the notice is deposited in the mail). The County may destroy any signs not retrieved by the deadline stated in the notice, and the permit holder will not be entitled to compensation for the value of signs so destroyed.
