3 FRUITA/MESA COUNTY TDR/C PROGRAM 3 Fundamental Components: 1) Intergovernmental agreement between Fruita and Mesa County (12/02); 2) City of Fruita Land Use Code and the Mesa County Land Development Code implementation regulations (2003, revised 2005); 3) User Manual - how to use the program.
4 INTERGOVERNMENTAL AGREEMENT ( Revised 2005)) Sending Areas - Community Separator & area within 2-3 miles of future Fruita 201 boundary. Receiving Areas inside Fruita 201 Area. Transfer Ratio of 1: 7 or 8 (1 TDR/C from unincorporated Mesa County = 7 or 8 additional dwelling units in the Fruita Receiving Area).

6 PRIVATE/VOLUNTARY MARKET-DRIVEN PROGRAM Value of Transferable Development Certificates is negotiated between willing seller and buyer. Mesa County and City of Fruita facilitate the process.
7 SENDING SITES 1. Evidenced by a Transferable Development Right/Credit Certificate issued by the Mesa County Planning Department. 2. Obtaining TDR/C Certificate first requires a recorded, perpetual Deed Restriction or conservation easement signed by the landowner.
8 SENDING SITES 3. A Sending Site with a TDR/C Certificate - is limited to any remaining density; - may only be developed as a Cluster; - may not be rezoned to a higher density or use. 4. Landowners choosing not to participate in the Program retain option to develop property per the Mesa County Land Development Code

11 FRUITA RECEIVING SITES 1. To receive a density bonus development rights/credits must be obtained from a Sending Site. 2. The Receiving Site must be annexed to Fruita and developed as a Planned Unit Development (PUD).
12 FRUITA RECEIVING SITES 4. All PUD s using TDR/Cs must be compatible with adjacent land uses and follow Fruita Community Plan. 5. Landowners choosing not to participate in Program retain option to develop per City of Fruita Land Use Code.

16 CURRENT PROGRAM SUMMARY One TDR credit is worth a bonus of 7 or 8 units in a Receiving area. No matter how many credits are purchased, overall density limits cannot exceed zoning limits in the Receiving area.
17 CURRENT PROGRAM SUMMARY 10 acres is the minimum eligible lot size for a Sending property 5 acres is the minimum area required to be protected (5 acres = 1 TDR credit) AFT, AF35, Urban Residential, Commercial, Industrial zoned properties are eligible Sending areas.
18 2005 PROGRAM CHANGES Increased the size of the Sending area from 1 mile outside to the 201 to over 2 miles outside the 201 area. Increased the current transfer ratio from 1 credit = 2.5 bonus units to 1 credit = 7 bonus units. to 1 credit = 8 bonus units if from the buffer.

20 2005 PROGRAM CHANGES Decreased the minimum eligible Sending site from 20 acres to 10 acres for AFT and AF35 zones. Decrease the minimum eligible Sending site from 20 acres to 5 acres for urban residential zones (RSF-E, RSF-2, RSF-4, etc. on the Redlands).
21 2005 PROGRAM CHANGES Added commercial and industrial zoned land to the Sending area (5 acre minimum eligible site) Changed the Fruita Receiving area by: Including all of the area between Hwy 6 & 50 and L Road and 18 ½ and 19 Roads Increasing the potential maximum bonus in this ½ mile strip from 2 units per acre to 4 units per acre.
22 Revised Receiving Area to include all of the area between Hwy 6 & 50 and L Road and 18 ½ and 19 Roads- both incorporated and unincorporated properties. Increased maximum bonus density to 4 units per acre from 2 units per acre in this strip.
