1 Date: Replies to Queries of the Bidders SUB: Replies to queries of the bidders against Tender for carrying out survey works, opening of ROU & Manmad in Nashik GA to Dhule GA (approx. 300 km) for REF: Bid Document No. MNGL/C&P/ /111 dated Dear Sir, Following are the replies to queries of the bidders. Kindly note the same. Sl. Bidder s Query Clarification MNGL s Reply No. 1 BIDDER s ELIGIBILITY CRITERIA You mentioned in said clause that works for (BEC)- 2.0 SCOPE OF WORK: lot 1 is proposed to carry out immediately & the survey works for the Lots II. III & IV shall be carried out subsequently after our intimation. Kindly clarify that the completion schedule is measures on basis of date of intimation for executing specific lot. (The time schedule specification requirements are mentioned below. Lot I: - From SV-18 at Mhaskal to Vasind 20 kms (approx.) Lot II: - From Vasind to Sinnar near Nashik 120 kms (approx.) Lot III: - From Sinnar to Manmad 70 kms (approx.) Lot IV: - From Manmad to Dhule 90 kms (approx.) The works for Lot 1 is proposed to carry out immediately & the survey works for the Lots II. III & IV shall be carried out subsequently after our intimation. Time schedule will be measure from the date of intimation, Separate time schedule for each lot is placed herewith BEC TECHNICAL 5.1 Technical Criteria: The bidder under a single contract and as a Main Contractor should have completed similar work of minimum 150 Km of Cross-Country Hydrocarbon pipeline route survey in India including experience of 3(i), 6(i) notification as per Petroleum Act and opening of ROU in the last Five (5) years reckoned from the Bid due date. We would like to inform MNGL that the 300 Km long pipeline project is very big project and BEC criteria is very low. Therefore, the many agencies will quote with less experience and project may get delayed. Hence, we request MNGL to kindly modify the clause in tender i.e The bidder under a single contract and as a Main Contractor should have completed similar work of minimum 200 Km of Cross-Country Hydrocarbon pipeline in India including BEC Technical will be modified as The bidder under a single contract and as a Main Contractor should have completed similar work of minimum 150 Km of Cross-Country Hydrocarbon pipeline in India including providing ROU acquisition services as per P&MP Act including providing assistance to Competent Authority for notifications as Page 1 of 8

Description: PERMISSIONS Railways /State highways/water body crossing/ Major District road/ Gram Panchayat Road/ OFC telephone cables/ State intimation PWD/Development Authority / ROU from Land owner/ Municipal permission OR any other authority Completion period: Within 5 months from date of Intimation 5 TIME SCHEDULE, (ANNEXURE-3 TO SPECIAL CONDITIONS OF CONTRACT TECHNICAL) Sr. No-5. Description: PERMISSIONS National Highway/ Social Forest / Protected Forest Completion period: Within 6 months from date of Intimation providing ROU acquisition services as per P&MP Act including providing assistance to Competent Authority for notifications as per P&MP Act, ROU opening works along with Survey works including Detailed Route Survey, Cadastral Survey, soil investigation, etc. as well as Liasioning services for crossing approvals like Forests, Water bodies, Rivers, National/ State Highways, etc. As mentioned in BEC criteria clause 2.0 Scope of work (Page No. 6 of 219) the work shall be carried out lot wise. Please clarify the time schedule shall be considered lot wise or else? We have executed similar works in Maharashtra State as well as in other states of India. Our experience says completion schedule should be at least 8 months for Railways /State highways/water body crossing/ Major District road/ Gram Panchayat Road/ OFC telephone cables/ State intimation PWD/Development Authority / ROU from Land owner/ Municipal permission OR any other authority. We have executed similar works in Maharashtra State as well as in other states of India. Our experience says for Protected forest completion schedule should be at least months, however for NH and Social forest permissions can be pursued within 8 months. Regional Empowered Committee (REC) gives permission of Protected forest. Application is processed through RFO, DFO, CF, CCF, APCCF (NODAL), PCCF, State Government, Regional Office & REC. per P&MP Act, ROU opening works along with Survey works including Detailed Route Survey, Cadastral Survey, soil investigation, etc. as well as Liasioning services for crossing approvals like Forests, Water bodies, Rivers, National/ State Highways, etc. Already clarified in Sr. No. 1 Time schedule will be revised to 8 months for Railways & for other crossings the time schedule will remain same. Completion schedule will be revised to 12 months form date of intimation Page 2 of 8

3 6 PART - G PRICE SCHEDULE / SCHEDULE OF RATES (SOR) Clause no. 1.9 Bidders are required to quote for all items of Schedule of Rates (PART - G). Table Sl. No. 1 RECONNAISSANCE SURVEY: Collection of latest Satellite Images / Survey of India Topo Maps / Master Plan of Area in requisite scale and Carrying out Desktop study based on the maps and reconnaissance survey having minimum two (02) route options. Submission of report (with details of each route) / drawings in the applicable scale in hard as well as soft copies as specified in Bid document (Payment shall be released only for final route selected by MNGL). The entire work is inclusive of mobilization and demobilization of resources. QTY: 20 Km (however, entire length is 300 Km) 7 PART - G PRICE SCHEDULE / SCHEDULE OF RATES (SOR) Clause no. 1.9 Bidders are required to quote for all items of Schedule of Rates (PART - G). Table Sl. No. 1 DETAILED ENGINEERING SURVEY: Carrying out Centre line and detailed REC will grant 1 st Stage Clearance (In- Principal Approval) and after compliance of 1 st Stage Clearance, working permission (2 nd Stage Clearance) accorded by PCCF followed the same channels. As only 20 km reconnaissance survey mentioned in SOR. For commencing the Detailed Route Survey of 300 km, please clarify regard to this. 1. Is reconnaissance survey for excluded line is done previously? 2. If you are supposed to follow any old route and lay with existing row, please provide details, as per our past experiences old route may be subjected to encroachments and new development reroutes may be proposed. In all our previous projects we have to conduct the reconnaissance survey for entire route before starting the Detailed Route survey. We suggest please modify the Reconnaissance survey quantity to 300, it may be unused if your proposed route shall be feasible. As per our information you have proposed to lay pipeline in existing pipeline Please clarify whether route has been proposed along the roads or cross country. You may aware that for laying along the road, there no need to execute the Cadastral survey. For 300 km of cadastral survey there may on hold large amount. Please modify the quantity for cadastral Survey and split from DES. The related job of cadastral survey may be restricted as per cadastral survey actual Agreed. Please see the revised SOR. Agreed. Submission of drawing/documents (Detailed Engineering Survey Report as per tender) in hard as well as soft copies as per requirement of tender documents and instruction of the MNGL. Carrying out Cadastral survey for RoU acquisition involving collection of execution. (a) Village Maps (Revenue Map), digitization of Village Map and transfer of alignment and ROU under acquisition in the maps. (b) Ownership details. (c) Field Measurement Book (FMB) etc. and submission to MNGL as specified in Scope of work/technical Specifications by providing all man power, tools, tackles, materials, equipment and other support, facilities (including mobilization and demobilization as required) necessary for the work, and as per instructions of MNGL. Submission of drawing/documents in hard as well as soft copies as per requirement of tender documents and instructions of MNGL. For around 280 km, the survey is to be carried out with respect to the Existing Pipeline. QTY: 300 Km for DRS & 300 Km for Cadastral Page 4 of 8

5 8 PART - G PRICE SCHEDULE / SCHEDULE OF RATES (SOR) Clause no. 1.9 Bidders are required to quote for all items of Schedule of Rates (PART - G). Table Sl. No. 1 Obtaining Permissions and Approvals: Obtaining approvals/ permissions from appropriate respective State/ National and other statutory authorities for various pipeline crossings enroute like National Highways, State Highways, other Roads, Railways, River, Canal/ Drain crossings or any other utility crossings etc. as per detailed scope of work specified in Special Conditions of Contract (SCC) and specifications of the tender documents and direction of Engineer-in- Charge/ Site Engineer. Integrating all details on Owner's Arc GIS (ESRI) server along the entire Pipeline Route. Note: 1) Payment shall be made for obtaining each permission. Cluster of crossings needing permission from same Authority shall be considered as one permission, for the purpose of payment. 2) For Railway crossings, each crossing shall be treated as separate and payment shall be made on unit basis. QTY: authority wise 9 Clause 5 Time Schedule The Time Schedule for Permissions National Highways /Social Forest /Protected Forest is given as Within 6 Months from date of intimation We request MNGL to kindly modify the payment terms in tender like various PSU companies do. Please be informed that, now a days all the PSU Company s like HPCL, GAIL, GSPL etc. are inviting tender with payment term to each number of crossing instead of authority wise. 7 11 Terms of Payments MAHARASHTRA NATURAL For Providing Services for Establishing ROU in ROW as per P&MP Act, We suggest the following payment terms a. After completion of all work upto the stage of serving of notices U/S 3(1) to individual land owners, arranging hearing of objections U/S 5(1) and disposal of the same by the Competent Authority. 30 % b. After Completion of all work upto the stage of serving notices U/S 6(1) to individual land owners. 30 % c. After completion of compensation work for ROU acquisition and balance work. 40 % Noted and following terms of payment will be applicable a. After completion of all work upto the stage of serving of notices U/S 3(1) to individual land owners, arranging hearing of objections U/S 5(1) and disposal of the same by the Competent Authority. 30 % b. After Completion of all work upto the stage of serving notices U/S 6(1) to individual land owners. 30 % c. After completion of compensation work for ROU acquisition and balance work. 20 % d. Entry of Pipeline/ Owner details in 7/12 of Farmers 20% 12 Terms of Payments For Providing Services related to opening of RoW. We suggest the following payment terms a. On Completion of Notice to land Owners, Panchayat, Govt Agencies etc. assisting CA Staff in Panchnama and other activities for RoW Opening etc. 60% b. Collection of yield/ rate of crops assistance to CA in preparation of award and final disbursement and on completion of balance work as per scope of work. Noted and following terms of payment will be applicable a. Assistance in appointment of CA, like submission of Letter, follow up with ministry and publication of CA name in Gazette after appointment -10 % b. On Completion of Notice to land Owners, Panchayat, Govt. Agencies etc. assisting CA Staff in Panchnama and other activities for ROW Opening etc. 50% Page 7 of 8

If not then the procurement will take time & if the cost towards procurement shall be borne by MNGL Please confirm quantity c. Collection of yield/ rate of crops assistance to CA in preparation of award and final disbursement and on completion of balance work as per scope of work. 40 % Images are not available with MNGL; Contractor has to collect or can do survey according to Google maps. Already clarified in Point no 13. Topo Survey is not required. Specification for Topographical Survey is given in scope but there is no SOR Item. If the item is to be executed 16 SOR Item 2 Detailed Engineering Survey Please confirm that existing pipeline drawing viz. (Route map, Cadastral, Gazette Notifications, As built drawings etc.) shall be supplied with LOA. For around 280 Km, the survey is to be carried out with respect to the Existing pipeline 17 Schedule of Rates (SOR) It is suggested to include separate GIS/LIS SOR item. The details related to existing line will be provided to the successful bidder. Tender condition prevails. Page 8 of 8
