1 RESOLUTON NO A RESOLUTON OF THE CTY OF PORT ORCHARD, WASHNGTON, GRANTNG FNAL PLAT APPROVAL FOR A 54-LOT and FVE TRACT PLAT KNOWN AS ELDON TRALS DVSON 2 WHEREAS, on July 26, 2007, the Kitap County Hearing Exainer approved the preliinary plat for a ubdiviion known a McCorick Wood Preliinary PlatPUD Phae V; and WHEREAS, on February 17, 2012, the City of Port Orchard Counity Developent Director iued a SEPA Mitigated Deterination of Non-Significance for the McCorick Wood Phae V Developent a a requireent of the Final Environental pact Stateent (FES) for the Planned developent of ULD #6; and WHEREAS, on February 14, 2017 the firt Diviion of the McCorick Wood Phae V plat, now naed Eldon Trail Diviion 1, for the ubdiviion of 33 lot, 19 tract and public rightof-way received final plat approval fro the City Council and wa ubequently recorded with the Kitap County Auditor; and WHEREAS, on March 21, 2017 a final plat application wa received for the econd Diviion of the McCorick Wood Phae V preliinary plat, now naed Eldon Trail Diviion 2, for the ubdiviion of 54 lot, 5 tract, and public right-of-way; and WHEREAS, the Director of Public Work ha deterined that the propoed ean of ewage dipoal and water upply are adequate and recoend approval of the final plat; and WHEREAS, the City Engineer recoend approval of the final plat; and WHEREAS, the City Counity Developent Director recoend approval of the final plat; and WHEREAS, the City Council find that Diviion 2 of the McCorick Wood Phae V plat, now naed Eldon Trail Diviion 2, confor to all ter and condition of the preliinary plat approval and that aid ubdiviion eet the requireent of Chapter RCW and other applicable tate law and local ordinance; and WHEREAS, the City Council find that Eldon Trail Diviion 2 confor to the applicable zoning requireent and Port Orchard' Coprehenive Plan; now, therefore;

2 Reolution No Page 2 of 2 AS FOLLOWS: THE CTY COUNCL OF THE CTY OF PORT ORCHARD, WASHNGTON, HEREBY RESOLVES THAT: The Port Orchard City Council approve the final plat for Eldon Trail Diviion 2, a illutrated and a legally decribed in Exhibit A, attached hereto; and FURTHER THAT: The Eldon Trail Diviion 2 ubdiviion hall be governed by the ter of approval of the final plat, and the tatute, ordinance, and regulation in effect at the tie of approval for a period of five year after final plat approval unle the City Council find that a change in condition ha created a eriou threat to the public health or afety in the ubdiviion.
