3 General Rules Minimum Age Requirement The CC&Rs establish the age limitation for Champagne Village. Residents must be at least 55 years of age, except in the case of a married couple or domestic partnership, where one spouse or partner may be under 55 but no younger than 45. Per Section 7.16 of the CVPOA CC&Rs: Each Condominium shall have as a permanent resident(s) therein person(s) who are Senior Citizens; provided that the spouse of a Senior Citizen who occupies the Unit, which spouse is less than 55 years old may (1) occupy along with that Senior Citizen, and (2) continue to occupy a Condominium after the death of that Senior Citizen so long as the provisions of the Acts and the regulations adopted thereunder are not violated by such occupancy. For the purposes of this section, an occupant shall not be considered a permanent resident unless such occupant considers the Unit to be his legal residence and actually resides in the Unit for at least six (6) months during every calendar year. Number of Residents per Unit Liability Guests The maximum number of permanent residents who may occupy a unit is limited to two people per bedroom. Any act committed within the confines of Champagne Village that would place the Champagne Village Property Owners in violation of any law or ordinance of the Federal Government, State of California or County of San Diego is prohibited. The conduct of guests is the responsibility of the resident being visited. Owners are liable for any damages caused by their guests or tenants. Adult guests are limited to 60 days in any calendar year. PAGE 1

4 Nuisance Residents and guests must conduct themselves so as not to interfere with or disturb their neighbors quiet enjoyment of their homes. As a common courtesy, loud noises and other disturbances should be avoided between the hours of 10:00PM and 8:00AM. Trespassing Trespassing through units (private property) is prohibited. Skateboards, Roller Skates, Roller Blades and Scooters Skateboarding, roller-skating, roller blading, scooters and similar activities are prohibited in Champagne Village. Estate and Garage Sales Estate sales within Champagne Village are permitted only with written permission from the Management. Items for sale may be shown to those outside Champagne Village by appointment only. The resident is responsible to notify the front gate of any nonresidents arriving. Soliciting and Distributing Materials Camping Door-to-door soliciting by both residents and non-residents is prohibited in Champagne Village. Residents may, however, distribute materials to other residents via the document delivery boxes at each unit. Camping is not permitted in Champagne Village. Signs, Banners and Flags Signs, flags and banners on private property must not exceed 15 square feet. Signs on the common areas are permitted only with the approval of the Board. Commercial signs are prohibited. Political signs may be displayed 90 days prior to an election and must be removed within 15 days after the election. These signs must not exceed 6 square feet. Real Estate and New Home Signs One real estate sign, not to exceed 24 by 36 inches, is permitted on private property. Corner lots are permitted two real estate signs, one from the front and one from the side. A smaller sign, not to exceed 3 by 12 inches, may be suspended from or placed above each real estate sign. 5 Open house signs may be displayed only during the hours when the house is open and available for viewing. All real estate signs must be removed within 14 days following the close of escrow. New home dealers may display a sign not to exceed 24 x 36 inches in a street-facing window, from the date of delivery to 15 days following the close of escrow. Any additional signs other than those authorized herein for the promotion of real estate sales or rentals is prohibited. Outside Furniture Only furniture manufactured for outdoor use is permitted on open porches or patios. Placement of Appliances Washing machines, dryers, refrigerators, freezers, water coolers, hot water heaters, and all other appliances must be located inside a residence or storage shed. Power Equipment Storage Storage of power tools (table saws, jigsaw, grinders, sanders, etc.) and workbenches is limited to the confines of storage sheds, except when in use for construction or remodeling projects. Outside freestanding or wall-hanging storage cabinets are not permitted without approval of the A&L Committee. Storage of personal property beneath any house is prohibited by California s Health and Safety code. Water Softeners Trash Only water softeners acceptable to our water district are permitted. All garbage and refuse must be well wrapped and placed in designated containers for pickup. Trash containers must not be put out prior to 4:00PM the evening before collection. Trash containers must be taken in as quickly as possible following trash collection, and kept in an area not easily visible from the street. Holiday Decorations Residents are encouraged to decorate the exterior of their homes in celebration of the various holidays. Exterior holiday decorations must be removed no later than 20 days after the holiday period ends. PAGE 3

6 Pets The following rules are enforceable by the CVPOA and, since they conform to existing County Ordinances, the San Diego County Department of Animal Control. In these Rules and Regulations, the word PET means any domesticated bird, cat, dog or aquatic animals kept within an aquarium, and is principally defined as a house pet. Service Dogs Certified guide dogs, signal dogs and service dogs are not considered pets. All service dogs must be registered at the Village Office. Two-Pet Rule Each unit is permitted a maximum of two pets in any combination of cats and dogs, in addition to any domesticated birds or aquatic animals kept within an aquarium. Pet Breeds Not Permitted The following pet breeds are not permitted for occupancy within Champagne Village: Pit Bull or Pit-Bull mix, Rottweiler or Rottweiler mix, Doberman Pinscher, Chow, and Wolf hybrid. No-Pet Areas Whether on or off leash, pets are not permitted in any common areas not designated as a pet area. This includes but is not limited to the Village Hall, recreational areas, the laundry room and Gathering Place, the mail center, the golf practice area, the tennis courts, the pool area, the grassy portion of the picnic area, picnic area concrete patio and all streets and sidewalks not in the dog walk area. Pets are not permitted on any private property other than the pet-owner s property. Dog-Walk Area The dog-walk area spans an area starting at the rear of the stage and continuing to the intersection of Ironwood, then along Ironwood toward to the RV area and finally northeast to the intersection of Ironwood and Sumac. 7 Dog Park Pets being walked in this area must be restrained by a substantial hand-held leash that is no longer than 6 feet, and must be in the charge of a responsible, competent adult who is physically capable of controlling the pet. Pet area locations are specified on the shaded areas of the attached Champagne Village map. The fenced dog park is an off-leash area where pets are allowed to run free. Users of this area must abide by the posted Rules. Pet Owner Registration and Agreement Guest Pets Prior to bringing a permanent cat or dog into Champagne Village, residents must obtain permission from the Association, execute a Pet Agreement, and register the pet by providing proof of vaccinations along with a current license and tag number (if applicable), and a photograph of the pet. All existing and new pets are subject to these registration requirements. Guests may temporarily bring approved pets into Champagne Village while visiting a resident, as described in the Two-Pet Rule. Resident owners are responsible for the conduct of each visiting pet, ensuring that they will abide by these Rules and Regulations. Residents are not permitted to temporarily care for pets from outside Champagne Village. Noise and Barking Noise from a dog is defined as barking or whining for more than five minutes in any onehour period: Barking that is excessive or persistent and occurs for an extended period of time or on a repeated basis. When determining if barking is a violation, consideration will be given to the time of day, duration and frequency of barking. No resident is permitted to keep, maintain or permit within any unit, or within the common areas or on private property, any pet that disturbs the peace and comfort of other residents in Champagne Village or interferes with any person s reasonable and comfortable enjoyment of life or property. Unattended Pets Owners must never leave their approved dogs unattended for more than 12 hours. Owners may not leave a pet tethered or unattended at any time. Any pet found running at large within the common areas or on any private property may be reported to the San Diego County Department of Animal Control. PAGE 5

8 Pet Waste No person owning or having charge of any pet will leave any animal waste within any of the common areas or on private property: this includes the pet walk areas and the pet park. All animal waste must be immediately picked up and deposited in one of the pet area trash receptacles or at the pet owner s home. Owners of pets not abiding by this policy are subject to the CVPOA Rules Enforcement Policy. Commercial Use or Breeding Residents of Champagne Village are prohibited from breeding, raising, keeping or training any pets for commercial purposes. Undisciplined Pets (Viciousness and/or Biting) Details provided to Management regarding any animal suspected of behaving viciously or allegedly biting someone will be reported to the San Diego County Department of Animal Control. Enforcement Pet owners must fully comply with these rules. Any resident observing infractions of these rules are asked to notify Management in writing. The Association reserves the right to determine whether any pet is a nuisance, based on the behavior of the individual animal and notwithstanding compliance with these rules and regulations. Failure to Abide Failure to abide by these rules will subject the unit owner to fines and other enforcement actions under the Rules Enforcement Policy, including removal of the pet in question. 9 Using Champagne Village Facilities Use of Facilities The CVPOA facilities are for the exclusive use of residents and their guests. All rules posted in the recreational areas are hereby made a part of these Rules and Regulations, and by this reference are incorporated herein as though set forth in full. As such, posted rules must be observed by all residents and guests. No Smoking All minors using CVPOA facilities must be accompanied by an adult. All common area facilities in Champagne Village are designated non-smoking. Swimming Pool and Hot Tub Pool and hot tub users must obey all posted rules. Hours of use for both adults and minor guests are posted in the pool area and must be followed. No one under the age of 14 years is permitted in the hot tub. Bulletin Boards Numerous bulletin boards are in three areas of Champagne Village: the mail center, the Village Hall, and the laundry room. Any non-cvpoa notices placed on these bulletin boards must be approved by the Management, and are posted for no more than 15 days. Each bulletin board is designated for a specific use, as described below. Mail Center Bulletin Boards. Four bulletin boards are located in the mail center: The CVPOA section on the right is used by the Board of Directors and Management to provide information for residents. The Personal and Services section in the middle may be used by residents for brief posts, not exceeding one page, to other residents. The left section is for posts of personal items for sale by residents, limited to a 3x5 inch card that is dated, approved and posted by Management. PAGE 7

10 The SAC bulletin board is the freestanding board, centrally located in the mail center. All items on this board are posted by the Social Activities Committee. Village Hall Bulletin Board. The Village Hall s bulletin board is located outside the card room, and is primarily used for sign-up sheets and travel or entertainment notices. Other notices may be posted on this board on a space-available basis, when approved and posted by the Management. Laundry Room Bulletin Board. The bulletin board in the laundry room is for general notices by residents, and may include pictures of items for sale by residents. Private Use (Rental) of Common Areas Who Can Reserve Any resident of Champagne Village in good standing may reserve the common area facilities for private gatherings, subject to compliance with the following rules and regulations. Events Permitted Residents may reserve the common area facilities for gatherings such as the celebration of a resident's or immediate family s wedding, anniversary, birthday, etc. In these Rules and Regulations, Immediate Family is a spouse, sibling, child, son- or daughter-in-law, parent, grandparent or grandchild. Outside commercial enterprises are only permitted to conduct business in CV facilities when requested by a resident and approved, in writing, by the Board of Directors. Any such business must be open to all residents and their guests. Political gatherings require the same approval process as commercial enterprises. Champagne Village facilities cannot be used as convention sites. Any private club or organization authorized by the Board of Directors to use CVPOA facilities must hold a majority membership of Champagne Village residents. (Membership rosters of these clubs and organizations must be submitted to the Management annually, each January.) Facilities Available for Private Use Facilities in Champagne Village that may be reserved for private events include the main room in the Village Hall, the Hall s card room, the Gathering Place, and the picnic facility. The swimming pool area may not be reserved for private use. PAGE 8

11 Reservations Deposits Any request to reserve CV facilities must originate from a resident. All reservations are contingent upon approval by Management. Dates reserved for Board or SAC activities take priority over private events. The Saturday night prior to Men's Sunday Breakfast is not available for private events, except by specific approval of Management. Security deposits for use of Champagne Village facilities, in amounts determined by the Board, must be provided to Management at least eight days prior to the event. Refunds of deposits (less any deductions) will be returned within 14 days following the event. Security deposits and janitorial fees are not required of individuals or groups holding memorial services for deceased residents of Champagne Village. Responsibility of Host Resident (Renter) The host resident is responsible for the following (refer to the Building Use Agreement for details): The host resident is deemed responsible for the condition of the facility following the event. The host resident must be in attendance at the event. The host resident is responsible for ensuring that attendance at any event does not exceed 378 people. The host resident is fully accountable for any damage or theft caused by themselves or their guests, as well as compliance with all rules and regulations. The host resident is responsible for ensuring that the function ends by 11:00PM (with the exception of the New Year's Eve party). The host resident is responsible for cleanup following the event. The janitorial service used by the CVPOA may be contracted to clean. Except for resident memorial services, the host resident will be charged for cleanup service, with the amount determined by the contractor. The host resident is responsible for access to Champagne Village by event. The host resident is responsible for providing valet parking for any event with 50 or more guests. The parking site to be determined by Management. PAGE 9

12 Rules for Private Use of Facilities Other than the use of existing hooks on the ceiling and light fixtures, decorations must not be attached to any walls or the ceiling of CVPOA facilities. Scotch tape is not to be used on any walls or posts. Appropriate fasteners may be obtained from the Village Office. Permanent décor must not be removed or covered. Whenever possible, entertainers should provide their own sound system. If the Village Hall s sound system is to be used, a refundable deposit will be required. Setup and breakdown of the sound system must be performed by trained, designated personnel. Food and Drinks All food preparation equipment must be carried through the back door of the kitchen: the front doors of the Village Hall must not be used for this purpose. Alcoholic beverages may not be sold in any Champagne Village facilities, nor can they be exchanged for any ticket, chip or token representing value. PAGE 10

13 Vehicles, Parking and Traffic In these Rules and Regulations, vehicle is any motor vehicle, including golf carts, unless otherwise stated. Vehicle Regulations Parking All vehicles operating in Champagne Village must obey the speed limit of 15 miles per hour. All resident vehicles operated within Champagne Village, except recreational vehicles (RVs), must display CV stickers on the driver's side rear window. No motorcycles, motor scooters, mini-bikes or other two-, three-, or four-wheel motorized vehicles, except golf carts, electric assisted bicycles and motorized vehicles used by the disabled, can operate in Champagne Village. Repairs, other than of an emergency nature, are not to be performed on any vehicle within Champagne Village. No vehicle is to be displayed for sale in the common area. Only vehicles owned or leased by residents may be washed in the designated vehicle washing area. Golf carts must be labeled using two-inch-high numerals that specify the owner s unit number, located on the back of the cart. Golf carts must only be operated by individuals 16 years of age or older. Any property damage or injury caused by a golf cart is the financial responsibility of the cart s owner. Overnight parking on any street is not permitted in Champagne Village. No vehicle is permitted to park on ground cover, gravel or dirt in any area of Champagne Village, whether on private property or in the common areas. Vehicles dripping fluid are not permitted to park anywhere in the common areas. Owners are responsible for any damage to the common area as a result of vehicle leaks. PAGE 11

14 Residents may park in designated guest parking areas when a guest vehicle is parked in their carport or driveway, or when their carport/driveway is temporarily inaccessible due to work being performed in the area. Under such conditions, the resident must notify the Management, specifying where their vehicle is parked and the estimated duration of use. No vehicle can be parked in any manner that blocks access to any driveway, or in any area, including the street, that poses a safety hazard or, in the judgment of Management, impedes the normal flow of traffic. All vehicles parked in posted areas or spaces must conform to the posted requirements. Golf carts must not be parked in lots or spaces reserved for cars, and cars must not be parked in lots or spaces reserved for golf carts. Except for loading and unloading, recreational vehicles must not be parked outside a residence. Parking for loading or unloading is limited to no more than six hours, not between the hours of 8:00PM and 8:00AM. RVs parked overnight on the street are subject to towing and a fine. No unusable or unsightly vehicles may be parked in the Village. No more than three motor vehicles are permitted to park at any unit without written approval of the Board. Motorcycles must park in the area designated for these vehicles. Recreational Vehicles (RVs) In these Rules and Regulations, Recreational Vehicle is a camper, motor home, boat, trailer or fifth-wheel trailer (that has a minimum of two windows and is exclusively used and originally built for recreational purposes). Any other type of vehicle will require the written approval from the Management to be eligible for storage in this area. Only recreational vehicles owned by residents are permitted in Champagne Village. Assignment of Space Only residents owning an RV are eligible for a space assignment in the RV storage area, with a maximum of one space per unit. When spaces are available, they may be assigned by the Management on a temporary basis for other types of vehicles belonging to a resident. When this is done, those space assignments must be vacated immediately upon request, for active RV parking. Proof of liability insurance and current registration in the name of the resident must be provided. PAGE 12

15 Rules of Use RVs must not exceed 38 feet in length. Spaces cannot be used by anyone other than the resident to whom it is assigned. During loading and unloading or when the RV is in use, parking of personal vehicles in the assigned space is permitted. Upon payment of a deposit, each resident assigned a space is provided a key to the area. These keys must not be duplicated or provided to any other individuals. Upon termination of the space assignment, the key must be returned to the Office, at which time the deposit will be returned. Any resident using the RV storage area is responsible for any damages resulting from such use. Should any damage occur, a written report must be provided to the Management within 24 hours. Electrical outlets in the RV storage area are for temporary use only, not to exceed eight hours. All personal items and equipment must be stored in the RV and not left out in the open. Residents are responsible for maintaining their space in a neat and orderly condition. The CVPOA is not responsible for any loss incurred by residents who park or leave vehicles or equipment within the RV storage area. Jacks and/or levelers must be on a one-foot-square base. Each RV must be centered between the parking centerlines, and as close to the fence as possible without providing a means of access to intruders climbing the fence. Waste dumping by RVs is permitted in the basin. After use, the basin must be hosed down and the hose hung up. When leaving the RV storage area, residents must lock the gate. Any RVs not used or removed from the storage lot during an 18-month period are subject to removal. Waivers due to illness or other circumstances are considered, and must be approved by the Management. PAGE 13

16 Leasing of Units Owners renting their property must provide a copy of an executed lease and complete and sign a registration form with the Office. Owners must provide their tenant(s) gate access and all necessary keys to the residence, mailbox, and pool area. Management will not provide these items to any tenant. Owners are responsible for providing their tenant(s) a copy of all current Governing Documents, which include the Bylaws, CC&Rs and these Rules and Regulations. Tenants are subject to all rules and regulations. Owners are responsible for any violations of the rules and regulations, and any damage to the common areas and facilities by their tenants. All leases must be for a period of 90 days or longer. Tenants are limited to two pets (refer to the Pet Rules in this document), and must register them with the Office. The number of permanent residents who may occupy any rental unit is limited to two people per bedroom. Guests of tenants are limited to 60 days in any calendar year. PAGE 14
