No petrol pumps shall be placed on the property hereby transferred or any part thereof nor shall any part of the said property be used for the sale thereon of any intoxiciating liquors nor as a betting shop nor for any kind of manufacture nor for any purpose which is noisy noxious or offensive and no act or thing shall be done or suffered thereon which shall be a nuisance or annoyance to the owners or occupiers for the time being of the land coloured blue on the said plan nor which shall interfere with the peaceful use of the said land coloured blue as place of religious worship Provided that the Transferee shall be permitted to carry on the user of car showrooms and ancillary offices and that this user shall not be a breach of this covenant nor of restriction number 2 hereof. 2. No building erected or to be erected upon the said property or any 3 of 4
4 Schedule of restrictive covenants continued part thereof shall (without the consent in writing of the Transferors or their successors in title) be used for any purpose other than as to the ground floor thereof showrooms of offices and as to the remaining floors offices or dwelling accommodation". NOTE: The remainder of the land comprised in Title No. MX referred to adjoins the Southern boundary of the land tinted pink on the filed plan. 2 The following are details of the terms of the modification contained in the Deed dated 3 November 1967 referred to in the Charges Register:- "The Trustees as Beneficial Owners hereby release and/or vary the said restrictions and stipulations as to the use of the land now bearing Title Number MX contained in the Schedule to the said Transfer of so as to permit the use of the said land and premises from time to time erected thereon as a motor car showroom and offices used in connection therewith and for the sale and fitting of motor car spares and accessories provided that no machinery or other thing shall be installed thereon or anything done or suffered thereon which might cause noise or annoyance to the Trustees or otherwise be a breach of the restrictions and stipulations contained in the said Transfer as hereby released and/or varied The Transferee for itself and its successors in title and so as to bind the said land and premises now bearing title number MX and to benefit the said land bearing title number MX belonging to the Trustees hereby covenant with the Trustees that the Transferee its lessees or tenants will observe and perform the said restrictions and stipulations as hereby released and/or varied". NOTE: The land tinted pink on the filed plan was formerly registered under title no. MX The following are details of the covenants contained in the Transfer dated 11 August 1988 referred to in the Charges Register:- "AND the Transferee with intent and so as to bind the land hereby transferred and each and every part thereof unto whosesoever hands the same may come and so as to benefit and protect the Transferor's property known as Viaduct Self Serve 354 Uxbridge Road Southall Middlesex and each and every part thereof hereby covennats with the Transfer (which dexpression shall include the Transfer's successors in title and assigns) that the Transferee and the successors in title of the Transferee shall not at any time hereafter use or permit the use of the land hereby transferred or any part thereof as a petrol filling station or for the purposes of the stock sale or distribution therefrom of motor fuels" End of register 4 of 4
