10 Nassau County Building Department Nassau Place, Yulee, Florida OWNER BUILDER AFFIDAVIT DISCLOSURE STATEMENT Florida State Statute, Chapter I understand that state law requires construction to be done by a licensed contractor and have applied for an owner-builder permit under an exemption from the law. The exemption specifies that I, as the owner of the property listed, may act as my own contractor with certain restrictions even though I do not have a license. 2. I understand that building permits are not required to be signed by a property owner unless he or she is responsible for the construction and is not hiring a licensed contractor to assume responsibility. 3. I understand that, as an owner-builder, I am the responsible party of record on a permit. I understand that I may protect myself from potential financial risk by hiring a licensed contractor and having the permit filed in his or her name instead of my own name. I also understand that a contractor is required by law to be licensed in Florida and to list his or her license numbers on permits and contracts. 4. I understand that I may build or improve a one-family or two-family residence or a farm outbuilding. I may also build or improve a commercial building if the costs do not exceed $75,000. The building or residence must be for my own use or occupancy. It may not be built or substantially improved for sale or lease. If a building or residence that I have built or substantially improved myself is sold or leased within 1 year after the construction is complete, the law will presume that I built or substantially improved it for sale or lease, which violates the exemption. 5. I understand that, as the owner-builder, I must provide direct, onsite supervision of the construction. 6. I understand that I may not hire an unlicensed person to act as my contractor or to supervise persons working on my building or residence. It is my responsibility to ensure that the persons whom I employ have the licenses required by law and by county or municipal ordinance. 7. I understand that it is a frequent practice of unlicensed persons to have the property owner obtain an owner-builder permit that erroneously implies that the property owner is providing his or her own labor and materials. I, as an owner-builder, may be held liable and subjected to serious financial risk for any injuries sustained by an unlicensed person or his or her employees while working on my property. My homeowner s insurance may not provide coverage for those injuries. I am willfully acting as an owner-builder and am aware of the limits of my insurance coverage for injuries to workers on my property. 8. I understand that I may not delegate the responsibility for supervising work to a licensed contractor who is not licensed to perform the work being done. Any person working on my building who is not licensed must work under my direct supervision and must be employed by me, which means that I must comply with laws requiring the withholding of federal income tax and social security contributions under the Federal Insurance Contributions Act (FICA) and must provide workers compensation for the employee. I understand that my failure to follow these laws may subject me to serious financial risk. 9 I agree that, as the party legally and financially responsible for this proposed construction activity, I will abide by all applicable laws and requirements that govern owner-builders as well as employers. I also understand that the construction must comply with all applicable laws, ordinances, building codes, and zoning regulations.

I understand that I may obtain more information regarding my obligations as an employer from the Internal Revenue Service, the United States Small Business Administration, the Florida Department of Financial Services and the Florida Department of Revenue. Licensed contractors are regulated by laws designed to protect the public. If you contract with a person who does not have a license, the Construction Industry Licensing Board and Department of Business and Professional Regulation may be unable to assist you with any financial loss that you sustain as a result of a complaint. Your only remedy against an unlicensed contractor may be in civil court. It is also important for you to understand that, if an unlicensed contractor or employee of an individual or firm is injured while working on your property, you may be held liable for damages. If you obtain an owner-builder permit and wish to hire a licensed contractor, you will be responsible for verifying whether the contractor is properly licensed and the status of the contractor s workers compensation coverage. Before a building permit can be issued, this disclosure statement must be completed and signed by the property owner and returned to Nassau County Building Department. 15 NOTICE FOR OWNER/BUILDER APPLICANTS FREQUENTLY ASKED QUESTIONS October 1, 2005(Revised 5/28/08) FLORIDA STATE STATUTE CHAPTER 489 REQUIRES THAT ALL PERMITS BE ISSUED TO A LICENSED CONTRACTOR. HOWEVER, YOU MAY OBTAIN A PERMIT UNDER AN EXEMPTION ALLOWED BY FLORIDA STATUTE CHAPTER (7) RELATING TO AN OWNER ACTING AS THEIR OWN CONTRACTOR. YOU WILL HAVE TO SIGN AN AFFIDAVIT THAT YOU WILL ABIDE BY THE REQUIREMENTS OF THIS EXEMPTION. THE FOLLOWING INFORMATION RELATES TO THOSE QUESTIONS MOST ASKED ABOUT THIS EXEMPTION AND THE PROCEDURE UTILIZED FOR VIOLATIONS OF THIS ALLOWANCE. Q. What is an owner/builder exemption? A. Section of the Florida State Statute allows for certain specific exemptions to the requirement for a license and in number (7) of the section it defines the owner/builder exemption and states specific rules and regulations for its use. Q. Who can obtain an owner/builder exemption? A. The listed owners of residential property that wish to build or improve their own single family or two family home or to build or improve a farm outbuilding and owners of commercial buildings that wish to build or improve their building if the cost to build or improve does not exceed $75, The improvement must be for the applicant s use. Q. What are the licensing requirements and who enforces the rules? A. The State of Florida requires that all individuals that perform the functions listed in Section of the Florida State Statutes be licensed as a contractor and the state enforcement agency for this statute is the Department of Business and Professional Regulation (DBPR). Q. How is the local Building Department involved? A. DBPR requires that the local Building Official require the presentation of an active Certified State License, proof of liability insurance and workers compensation insurance before the issuance of any permit that would require a licensed contractor, an active registered state license also requires a bond and a copy of an active Occupational License (Florida Statute 489) Q. Are there any rules for the residential exemption? A. Yes, The owner/builder must comply with the following: 1. Owner/builders are required to be knowledgeable in the adopted technical codes Including the Florida Building Code, Mechanical, Plumbing, Gas, Fire code, as well as, the National Electric Code (NFPA-70) in use at the time of application.

16 The owner must provide direct on site supervision for all work not done by a Licensed contractor. 3. The owner must hire a properly licensed contractor for any work not performed or directly supervised by him or her. 4. If work is done by other than the owner, or a licensed contractor, that individual, must work for the owner and be under the direct supervision of the owner. The owner must have F.I.C.A. and withholding taxes deducted from the individuals pay. The owner must also provide workers compensation insurance for that individual as prescribed by law. The owner cannot hire Day-Labor. 5. The owner/builder must be constructing the residence or building for his/her own use or occupancy and cannot sell or lease the building before one year after the completion of the building. (Date of issuance of Certificate of Occupancy by the Building Department) 6. The owner/builder must be cognizant of and is responsible for compliance with all applicable laws, ordinances and all building codes requirements relating to required inspections, permit expiration, survey requirements, notice of commencement, temporary rest room facilities, dumpsters, temporary electrical power and zoning regulations that pertain to the construction. Q. Are there any rules that are different for commercial buildings? A. Yes, All of the residential rules apply with the addition that the entire commercial building must be owned and occupied by the owner/builder. No portion may be rented or leased within one year of completion of the building or improvement. Q. How is this one year requirement determined? A. Proof of the sale or lease, or offering for sale or lease, of any structure by the owner/builder before completion or within one year after completion creates a presumption that the construction was undertaken for sale or lease. Q. Are there any penalties for violation of the rules and how are they enforced? A. Yes, when a violation of the rules governing the owner/builder exemption has been determined to exist the Building Official is required by DBPR to issue a STOP WORK order and notify DBPR of the violation. DBPR has the jurisdiction and authority to investigate the alleged violation and if appropriate assess fines of up to $5, and, if the project is not complete, require that the owner/builder hire a properly licensed contractor to complete the project. Q. Can an owner/builder build his or her own swimming pool or property fencing? A. A swimming pool is included in this exemption, although separate permits and rules apply. A fence does not require a licensed contractor and is therefore allowed to be constructed by the owner/builder. Q. Who is responsible if a licensed contractor hired by the owner/builder violates a law, code or ordinance? A. The owner/builder is ultimately responsible for any work done while he/she is acting as a contractor under the exemption.

17 - - 3 Q. What is a stop work order? A. A stop work order (RED TAG) is a notice from the Building Department that a violation of a law, code or ordinance exists and that no further work can be done until the violation has been corrected and approved by the Building Official. Q. What if work continues after the issuance of a stop work order? A. Continuation of work after the issuance of a stop work order is a misdemeanor punishable by arrest, up to (30) thirty days in jail and a fine up to $ Q. Who is responsible for scheduling and obtaining any required inspections under a permit issued to an owner/builder? A. The owner/builder if listed as contractor (not anyone hired by him or her) is ultimately responsible for obtaining any inspection that may be required. FINAL INSPECTIONS ARE REQUIRED ON ALL PERMITS. FAILURE TO OBTAIN FINAL INSPECTIONFMAY RESULT IN ADDITIONAL FEES.

18 Nassau County Building Department Inspection Types February 6, 2001(Revised 9/15/15) INSPECTION REQUESTS ARE REQUIRED TO BE INITIATED BY THE PERMIT HOLDER, ALL INSPECTION REQUESTS SHALL SUPPLY THE PERMIT NUMBER FOR EACH TRADE REQUESTED, THE TYPE OF INSPECTION, THE NAME OF THE INDIVIDUAL MAKING THE REQUEST AND A TELEPHONE NUMBER WHERE THE INDIVIDUAL CAN BE REACHED IF NECESSARY. THE FOLLOWING IS A LIST OF THE MODULAR HOME INSPECTIONS PERFORMED BY THE NASSAU COUNTY BUILDING DEPARTMENT WITH A BRIEF DESCRIPTION OF THE PURPOSE FOR THE INSPECTION INSPECTIONS REQUESTED FOR THE FOLLOWING WORK DAY MUST BE CALLED IN PRIOR TO 4:00 P.M. THE DAY BEFORE. TYPE DESCRIPTION 100 FOOTER/FOUNDATION: This inspection is made after a foundation or footing has been dug and all required re-inforcement or inbedded items have been placed and before any concrete has been placed MOBILE HOME TIE DOWN- This inspection is made after any wind load related and required strapping or attachments are in place and before skirting is installed around the perimeter of mobile home and before the final mobile home inspection. Permit will be void if this inspection is not completed within 30 days of permit issuance. 210 ELECTRICAL TEMPORARY: This inspection is made after the temporary pole or temporary installation is complete and before the meter is set and power connected. 260 ELECTRIC METER SET: This inspection is made after all electrical components are in a safe condition with all required grounding in place, has a signed pre-power agreement and is utilized to have electrical power for the purpose of hot checking appliances and circuits. (This is NOT a final electrical inspection) 299- ELECTRICAL FINAL/CHANGE OUT: This inspection is made after all components, fixtures, equipment and appliances indicated on the approved construction drawings have been installed and the electrical system is in a complete, safe and code compliant state and ready to be used. 350 PLUMBING ROUGH/GROUND: This inspection is made after all plumbing piping has been installed under the slab and before concrete is poured and is not covered up with dirt over any connections and has the required 10 ft. head of water on drainage piping and required pressure of approximately 80 to 100 PSI on water piping. (This inspection is utilized to determine if there are any leaks in the system and if the proper materials were utilized) 399 PLUMBING FINAL: This inspection is made after all plumbing fixtures have been installed,

19 2 are operational and the system is ready for its intended use. 450 MECHANICAL ROUGH: This inspection is made after the air conditioning or hood exhaust ductwork has been installed, and prior to being covered up with any construction material and is utilized to ascertain that the installation has been properly supported and meets the code requirements. 499 MECHANICAL FINAL: This inspection is made after all components of a mechanical system are installed are operational and ready for its intended use. 600 INFORMATIONAL VISIT: This inspection is made when a citizen or contractor is unsure of a requirement or needs assistance with the project and is at the discretion of the Building Official or the Building Inspector. 999 FINAL INSPECTION: This inspection is a required inspection on all permits issued including demolition permits and is utilized to insure that all aspects of the project or individual permit have been completed, meet all applicable codes and ordinances and that the building, installation or demolition is complete and ready for its intended use. F99 - FEMA Final Inspection: This inspection is made on all structures located in a special flood hazard areas (SFHA) after both elevation certificates (under construction & finished construction) have been received and approved by the Floodplain Administrator. Hydrostatic flood vents are installed (if required) and all electrical & mechanical equipment is in place. This inspection will be performed concurrent with the building final inspection. FINAL INSPECTIONS ARE REQUIRED ON ALL PERMITS. FAILURE TO OBTAIN FINAL INSPECTION MAY RESULT IN ADDITIONAL FEES

Provide the owner s name, address and phone number on the plan 2. Provide engineer s name, address, phone and fax number on plan 3. Indicate the number of structures on site (New and Existing) 4. Provide construction type for each structure, include truss and frame type 5. Indicate number of floor per building 6. Provide square footage per building per floor 7. Provide proposed building and eave height 8. Indicate address(es) for each existing structure 9. Place the minimum required fire flow upon the proposed site plan, use FFPC and table include specific construction type Provide the following comments: 10. Water for firefighting purposes shall be indicated with a blue roadway reflector placed one foot off the center line of the road facing the fire hydrant. This includes new AND existing sources (NFPA 1: ) A 36 in. (914 mm) clear space shall be maintained around the circumference of fire hydrants except as otherwise required or approved (NFPA 1: ) A clear space of not less than 60 in. (1524 mm) shall be provided in front of each hydrant connection having a diameter greater than 21 2 in. (64 mm) Water for firefighting purposes shall be available at the time combustibles are brought onsite. New fire hydrant(s) shall be installed so that a four and one-half (4½) inch port is facing the roadway by which it is accessed. Hydrant(s) shall be positioned not more than five (5) feet away from the curb or berm of the roadway. Also, all hydrants shall be readily accessible without the need to transverse swales, ditches etc.

25 BOARD OF COUNTY COMMISSIONERS NASSAU COUNTY FIRE RESCUE Fire Prevention Nassau Place, Yulee, Florida (904) or (855) Fax (904) Building Access Provide the following notation: Access shall be provided by an unobstructed, 20 foot wide, all weather driving surface capable of supporting a 32 ton emergency vehicle. The driving surface shall be maintained during all phases of construction Fire department access roads shall have an unobstructed width of not less than 20 ft A fire department access road shall extend to within 50 ft (15 m) of at least one exterior door that can be opened from the outside and that provides access to the interior of the building. Fire department access roads shall be provided such that any portion of the facility or any portion of an exterior wall of the first story of the building is located not more than 150 ft (46 m) from fire department access roads as measured by an approved route around the exterior of the building or facility. Fire department access roads shall have an unobstructed vertical clearance of not less than 13 ft 6 in. Dead-end fire department access roads in excess of 150 ft (46 m) in length shall be provided with approved provisions for the fire apparatus to turn around. For fire rescue access, a minimum roadway radii on a county maintained road shall be no less than 25 feet. For fire rescue access, a minimum roadway radii on a State maintained road shall be no less than 35 feet. A cul-de-sac shall have a minimum radius of 50 feet depending on ordinance Access Box(es). The AHJ shall have the authority to require an access box(es) to be installed in an accessible location where access to or within a structure or area is difficult because of security. The access box(es) shall be of an approved type listed in accordance with UL NFPA

The AHJ shall have the authority to require fire department access be provided to gated subdivisions or developments through the use of an approved device or system NFPA All gates shall have a clear width of 20 feet Access Maintenance. The owner or occupant of a structure or area, with required fire department access as specified in or , shall notify the AHJ when the access is modified in a manner that could prevent fire department access. NFPA Bridges. When a bridge is required to be used as part of a fire department access road, it shall be constructed and maintained in accordance with nationally recognized standards The bridge shall be designed for a live load sufficient to carry the imposed loads of fire apparatus Vehicle load limits shall be posted at both entrances to bridges where required by the AHJ Marking of Fire Apparatus Access Road Where required by the AHJ, approved signs, approved roadway surface markings, or other approved notices shall be provided and maintained to identify fire department access roads or to prohibit the obstruction thereof or both A marked fire apparatus access road shall also be known as a fire lane. Fire lanes shall be marked with a freestanding signs with the wording, NO PARKING FIRE LANE BY ORDER OF THE FIRE DEPARTMENT. Sign shall be 12 in. by 18 in. with white background and red lettering and shall be a maximum of seven feet in height from the roadway to the bottom part of the sign. The signs shall be within sight of traffic flow and be a maximum of 60 feet apart Water Supply, Water Mains, Fire Hydrants and Fire Department Connections Indicate on and off site water main sizes supplying the sprinkler and standpipe systems

(Per code maximum travel distance is 500 feet) Show the location, type, and capacity of any alternative water sources such as cisterns, dry hydrants and any static water sources to be used for fire flow requirements. Show location of all Fire Department Connections. There shall be a hydrant within 100 feet of a Fire Department Connection Fire Department Connections shall NOT be located on building but must be remotely located on the site. If multiple FDC s are required they must be marked as to which building or area they supply. Locking FDC caps required FDC sign required must state No Parking FDC or FDC on a white Sign with 6in red letters Note: Water models may be required for higher fire flow requirements, systems that have long pipe runs, unusual or questionable layouts or as deemed necessary by this office. To help expedite your plans, engineers are encouraged to submit water models before formal submittals are made to the fire prevention office Fire Flow Requirements for Buildings * Scope * The procedure determining fire flow requirements for buildings hereafter constructed or moved into the jurisdiction shall be in accordance with Section Section 18.4 shall not apply to structures other than buildings Definitions. See definitions , Fire Flow Area, and , Fire Flow Modifications Decreases in Fire Flow Requirements.

28 BOARD OF COUNTY COMMISSIONERS NASSAU COUNTY FIRE RESCUE Fire Prevention Nassau Place, Yulee, Florida (904) or (855) Fax (904) * Fire flow requirements shall be permitted to be decreased by the AHJ for isolated buildings or a group of buildings in rural areas or suburban areas where the development of full fire flow requirements is impractical as determined by the AHJ The AHJ shall be authorized to establish conditions on fire flow reductions approved in accordance with including, but not limited to, fire sprinkler protection, type of construction of the building, occupancy, development density, building size, and setbacks Increases in Fire Flow Requirements. The minimum required fire flow shall be permitted to be increased by the AHJ where conditions indicate an unusual susceptibility to group fires or conflagrations. An upward modification shall not be more than twice that required for the building under consideration Fire Flow Area General. The fire flow area shall be the total floor area of all floor levels of a building except as modified in Type I (443), Type I (332), and Type II (222) Construction. The fire flow area of a building constructed of Type I (443), Type I (332), and Type II (222) construction shall be the area of the three largest successive floors Fire Flow Requirements for Buildings One- and Two-Family Dwellings Not Exceeding 5000 ft2 (464.5 m2) The minimum fire flow and flow duration requirements for one- and twofamily dwellings having a fire flow area that does not exceed 5000 ft2(464.5 m2) shall be 1000 gpm (3785 L/min) for 1 hour * A reduction in required fire flow of 75 percent shall be permitted where the one- and two-family dwelling is provided with an approved automatic sprinkler system * Where one- and two-family dwellings are proposed to be constructed in areas where water distribution systems providing fire flow were designed and installed prior to the effective date of this Code, the AHJ shall be authorized to accept the previously designed system fire flow where the one and two-family dwellings are provided with approved automatic sprinkler systems A reduction in fire flow shall be permitted for building separation distance in accordance with and Table

29 BOARD OF COUNTY COMMISSIONERS NASSAU COUNTY FIRE RESCUE Fire Prevention Nassau Place, Yulee, Florida (904) or (855) Fax (904) Where multiple buildings are located on a single lot, the building separation distance shall be the distance between the buildings Where a building abuts a lot line, the building separation distance shall be the distance between the building and the lot line Where a building is contiguous to a public right of way or no-build easement, the separation distance shall be the distance between the building to the opposite side of the right of way or no-build easement Where multiple buildings are located on a single lot and abut a lot line, the building separation distance for determining fire flow reduction shall be the smallest of the two distances. Table Permitted Fire Flow Reduction for Building Separation Distance between buildings on a single lot Greater than 30 ft. but = 50 ft. Separation Distance to lot line or easement Greater than 15 ft. but = 25% 25 ft. Greater than 50 ft. Greater than 25 ft. 40% Permitted Fire Flow Reduction Buildings Other Than One- and Two-Family Dwellings The minimum fire flow and flow duration for buildings other than one- and twofamily dwellings shall be as specified in Table Required fire flow shall be reduced by 75 percent when the building is protected throughout by an approved automatic sprinkler system. The resulting fire flow shall not be less than 1000 gpm (3785 L/min) Required fire flow shall be reduced by 75 percent when the building is protected throughout by an approved automatic sprinkler system, which utilizes quick response sprinklers throughout. (4) The resulting fire flow is not less than 1000 gpm (3785 L/min) Minimum Number of Fire Hydrants for Fire Flow The minimum number of fire hydrants needed to deliver the required fire flow for new buildings in accordance with Section 18.4 shall be determined in accordance with Section The aggregate fire flow capacity of all fire hydrants within 1000 ft (305 m) of the building, measured in accordance with and , shall be not less than the required fire flow determined in accordance with Section * The maximum fire flow capacity for which a fire hydrant shall be credited shall be as specified by Table Capacities exceeding the values specified in Table shall be permitted when local fire department operations have the ability to accommodate such values as determined by the fire department Fire hydrants required by and shall be included in the minimum number of fire hydrants for fire flow required by
