11 CORRESPONDENCE/MEMORANDUM State of Wisconsin DATE: May, TO: FROM: Douglas County Land and Water Committee Donalea Dinsmore, Great Lakes Beach Program Coordinator, WDNR SUBJECT: Proposal to designate Shafer Beach as a non-swimming location until landfill closed Recommendation Temporarily inactivate Shafer Beach from Wisconsin s list of recreational beaches until the landfill closes and bacteria levels through the swimming season can be reevaluated and shown to have improved. Since this location has a long history of being on the beach list, removing the beach from the list could be accomplished by the county posting this location as No Swimming so people are alerted that they should not swim at this location. Beach Act funding for monitoring coastal beaches is quite limited and this action would reduce or eliminate the priority for monitor and available funds can be allocated to the other Wisconsin Point locations where more people swim. Background Shafer Beach (WP) is listed as a Wisconsin recreational beach on our official beach list. The Wisconsin Point Area Management Plan identifies Douglas County as the landowner with a recommendation that the management emphasis be habitat protection and restoration. In past years, this beach area has been closed to recreation until June while piping plover are in their nesting season. This is an area where we observe many birds feeding on material most likely scavenged from the open landfill. Figure Wisconsin Point,, and and extent of Shafer Beach (WP) Over the past several years, a sizeable percentage of samples exceed the criteria for posting advisories or closing the beach. Over the last 0 years of monitoring, Shafer Beach has typically had the highest E. coli concentrations along Wisconsin Point and it s not uncommon for 0% of the samples to exceed the threshold for posting an advisory. The tables below are excerpted from the beach reports as an illustration. Shafer Beach (Wisconsin Point Beach #) has been listed as an impaired water since 0 with E. Coli as the pollutant.

Through the Area of Concern (AOC) Program, DNR contracted with University of Superior Lake Superior Research Institute (LSRI) to evaluate the likely sources of bacterial contaminants at beaches in the AOC in Superior and Duluth and develop recommendations for those that fell within that program s purview. This investigation, which concluded in, used DNA markers for indicators of human sewage, bovine (e.g. cows), and gulls. The results of the study confirmed that birds were the primary source of E coli at Shafer Beach with little evidence of the other markers. The study concluded that the water quality issues at this beach were outside of the scope of the AOC program. The options for controlling birds along Shafer Beach appear limited to hiring a contractor with a trained dog to deter the bird
13 population along this span of beach. With the open landfill providing a continuing food source, the effectiveness of this approach is questionable. If this location remains open to in-water recreation, it needs monitoring. The number and magnitude of water quality exceedances along Wisconsin Point from Lot to the lighthouse decrease with distance from the area at the base of the Point. Several actions to improve beach water quality are occurring. The parking areas are being reconstructed with permeable surfaces to reduce runoff and a dune restoration is occurring. The Dutchman Creek watershed contributes to bacterial contamination at the beach at the river mouth. Sporadically, human sources for the bacteria were detected suggesting potential issues with septic tanks. Investigating and controlling the watershed sources will take a more extensive investigation. This watershed it outside of the AOC so information is limited to the DNA source identification. The area surrounding Barkers Island inner beach has a redesign plan that is focused on reducing stormwater runoff and control the bird population. Additional work is being done by the City of Superior to identify sources of bacteria coming from Faxon Creek and Pickle Pond. Work is planned for the Pickle Pond area. EPA provides some funding for monitoring and public notification for coastal beaches through the BEACH Act grants. This funding has been diminishing over time and the current allocation is $,000. (Historic funding levels are reported in the grant reports posted on the DNR website.) Grant guidance instructs beach programs to established tiers or priorities for monitoring. If a beach is on the impaired waters list, it is an important consideration as well as overall usage of the beach. Grant funding is stretched to capacity with various communities and counties providing staff or funding to implement program activities. In and, monitoring costs were off-set by the grant to assess the beaches within the Saint Louis River AOC as part of the source tracking project. Current costs for LSRI to monitor the beaches along Wisconsin Point (/week) and Barker s Island (/week) are $00 without including Shafer Beach. The cost estimate to include Shafer Beach with sampling /week for the season is approximately $00 which does not include posting the advisory signs. In lieu of monitoring, an option is to post the beach as No swimming at least until the landfill closes and the situation can be assessed. Simply posting is a reasonable approach and anyone who does choose to be in the water does so at their own risk.
