1 WHATCOM COUNTY COUNCIL SPECIAL COUNCIL MEETING Thursday, March 27, 1986 The Special Whatcom County Council meeting was called to order at 7:05 p.m. by Chairman Hansey. All Councilmembers were in attendance. Chairman Hansey explained that the Special Council meeting was scheduled in order to hold two public hearings; consider final adoption of an ordinance; and to discuss insurance coverage for Whatcom County with Executive Van Zanten. Bill Trimm, Planning Director, introduced Diane Harper, project planner for Chuckanut-Lake Samish Comprehensive Plan. Diane Harper summarized the information on the four commercial areas for which the public hearing was held. Chairman Hansey declared the meeting open for public hearing to discuss the following two ordinances: ORDINANCE ADOPTING AND AMENDING TITLE 20, THE OFFICIAL WHATCOM COUNTY ZONING ORDINANCE, FOR THE GEOGRAPHIC AREA KNOWN AS THE CHUCKANUT-LAKE SAMISH SUBAREA OF WHATCOM COUNTY. ORDINANCE AMENDING THE 1970 WHATCOM COUNTY COMPREHENSIVE PLAN TEXT AND MAP FOR THE GEOGRAPHIC AREA KNOWN AS THE CHUCKANUT-LAKE SAMISH SUBAREA OF WHATCOM COUNTY. The following people spoke at the public hearing: Ed Harris 371 Shallow Shore Rd. Bruce Harris 135 Summerland Rd. Ed Harris Hank Scharring Representing the Lake Samish Area Citizens for Appropriate Development. He presented a petition against creating two new Tourist Commercial and two new Neighborhood Commercial zoning designations. He also presented a position paper to the Council from this group. Explained the map which indicated distribution and range of commercial services. available along the Lake Samish/I-5 corridor. Summarized the findings of his group; urges denial of the Piha/Rooney Neighborhood Commercial proposal. Against commercial zoning in the county; supports downtown for commercial zoning only. 8

Read her letter to the Council; against removing present Tourist Commercial zoning; against proposed Tourist Commercial zoning; suggests reinstatement of original TC zoning for most of the area. Supports proposed Commercial zoning on his property. Supports rezoning the area North of Tamman Road as Rural. Stated that he sent two letters to the Council in support of Neighborhood Commercial zoning for his business. He also informed the Council about problems of water and sewer in the area where he is located. Prefers Neighborhood Commercial for her area if the other proposed Commercial zones were approved. Supports Al & Carmin's Market for N.C. zoning. Representing Morri~ Piha; supports Neighborhood Commercial zoning for Piha's property. Distributed information to Council. Representing some of the people who live in the area where her and her husband reside. She read a letter addressed to the Council. Spoke against any rezoning in the Lake Samish area except where Al & Carmin's Market is. located. Spoke in support of having the Lake Samish area remain as a rural residential area. 9

Supports rezoning for his property so that he can make improvements. Doesn't believe that any more services are necessary in the area; supports reasonable development where Al & Carmin's Market is located. Chairman Hansey closed the public hearing at 9:10 p.m. The meeting recessed at 9:10 p.m. The meeting reconvened at 9:20 p.m. Chairman Hansey stated that the two ordinances would be brought before the Council for final consideration or further action in three weeks (April 17, 1986). FINAL CONSIDERATION OF ORDINANCE QRDINAN~AMENDING ORDINANCE 86-9 TO MORE CLEARLY SET FORTH THE APPLIC~IJY OF THAT OR~INANCE TO CERTAIN PROPERlIES SITUATED ADJACENT JO POWER LINE RIGHJS-DE WAY Councilmember Johnson reported that the Planning and Development Committee had reviewed and recommended approval of the ordinance. JOHNSON MOVED TO ADOPT THE ORDINANCE AMENDING ORDINANCE 86-9 TO MORE CLEARLY SET FORTH THE APPLICABILITY OF THAT ORDINANCE TO CERTAIN PROPERTIES SITUATED ADJACENT TO POWER LINE RIGHTS-OF-WAY. The motion carried (6 - Hawley absent) ADDENDUM DISCU~SION REGARDING STATUS OF INSURANC~ COVERAGE FOR THE.c..Q.lJlITL Executive Van Zanten informed the Council that a meeting had taken place on February 19, 1986 regarding insurance for Whatcom County; the meeting was attended by Dave McEachran, Gene Moses, Brian Griffin, and four councilmembers. Executive Van Zan ten distributed a memo of the Tort Claims Fund. regarding the status Brian Griffin, representing the firm of Griffin, Garrett, Johanson & Schact, Inc., addressed the Council about the status of the insurance industry. Mr. Griffin presented his proposed insurance coverage which was displayed on a chart. 11
