1 ARCH 6521 Professional Practice & Management YIA st Term Coordinator: Bernard V. Lim ( bvlim@cuhk.edu.hk) Instructors: Mr. Michael Ma Mr. Dominic Lam Mr. Frank Yu Dr. L.K.Chan ICAC Representative DESCRIPTION This course is offered to Master of Architecture students who have completed their first degree in architecture and their year-out practical training. While in line with the HKIA/ARB professional practice assessment requirements, it is a continuation of ARC The course gives an insight into local development controls, such as the various statutes, regulations, leases, and codes of practice, and the architect s relationship with the controlling authorities. It looks into the architectural office structure, management, and codes of professional conduct, ethics and corruption prevention within the profession. It touches also on the role of the architect, scope of services, terms of agreement, and the architect s relationship with the allied professions. The course covers principles on the building contract and its legal framework. It examines the HKIA/HKIS Standard Form of Building Contract, illustrated with examples and practical experience of how an architect manages the building contract. Special reference is made to the clauses which usually attract disputes or negligence on the part of the architect encounters in daily practice. These clauses include certificates, completion, liquidated damages, extension of time. A brief introduction on the dispute resolution method of arbitration, mediation and court litigation will be studied through. Reference will be made to case law. (Online version up to here) The course selects topical development issues to examine the challenges of the practice of architecture and related professional disciplines in Hong Kong. While essentially based on the Hong Kong context, the course also covers aspects of overseas practice as well as in Mainland China with its growing importance and connection with Hong Kong architects. OBJECTIVES This course is meant to prepare the students in the handling of professional matters once they graduate from the MArch programme, to help them integrate into the profession and begin their professional training with an aim of obtaining professional qualification in Hong Kong.

2 LEARNING OUTCOME Upon the completion of the Programme, students will have acquired advanced understanding of professional issues related to the subjects such as the Role of Architects, Building Contract, Professional Conduct and Practice outside Hong Kong, acquired knowledge of aspects of the subjects with exposure at a suitable level to allow professional development. Chan inception to completion phase with case studies 26 Nov No Class - Final Review INSTRUCTORS PROFILE Dr James Lee LLD, LLM, LLB, BArch, BA(Arch Studies), FHKIA, RIBA, RAIA, FHKIArb, FCIArb, MAE, MSCL is a Chartered Architect, arbitrator, dispute resolution advisor, adjudicator, mediator, expert and a practising barrister-at-law. He has delivered talks/lectures on arbitration/mediation in public seminars and universities. He is an Authorized Person, Chartered Architect (in UK, HK, Australia), Asia Pacific EC Architect and also possesses Class 1 PRC Registered Architect Qualification. He is accredited expert of the Academy for Experts and is arbitrator/mediator on various panels in Hong Kong and Mainland China (which includes CIETAC, HKIAC, HKIA/HKIS, Bar Association, HKIArb, etc.). He has served on many occasions as assessor in various mediation training and assessment. He has sit on various government appeal tribunals and disciplinary boards. His major practice both in arbitration and mediation is in construction related disputes. He is the author of A comparative Study and Case Analysis on the Recognition and Enforcement of Arbitral Awards between the Mainland and Hong Kong [People s Court Press] and has published various articles in journals on arbitration/mediation. Clients have included HK Government, Airport Authority, MTRC, KCRC, URA, Public Works Canada, British Columbia Building Corporation, and the private sector. As Director at Foster and Partners, he was the Authorized Person Architect for Hong Kong International Airport Passenger Terminal Building (HKIA Silver Medal winner) as well as KCRC Hung Hum Rail Terminus Extension (HKIA Certificate of Merit winner). He has more than 25 years of professional experience and is presently the Managing Director of Nan Fung Development Ltd. Former Chairman of the Architects Registration Board, HKSAR Former Council Member of HKIA Former External Examiner of the Art School, Hong Kong Arts Centre Taught in Design Studios in the Department of Architecture, HKU Member of Construction Industry Training Board Co-founder of the Young Architects League Director of the Hong Kong Architecture Centre graduated from the University of Hong Kong and the University of London in the 1980s with a First Class Honour degree in Quantity Surveying and a Master of Science in Architecture respectively. He also has a Juris Doctor degree (Credit) from the City University of Hong Kong. He is a Fellow of the Hong Kong Institute of Surveyors, Fellow of the Royal Institution of Chartered Surveyors, Fellow of the Chartered Institution of Civil Engineering Surveyors, a Registered Professional Surveyor (Quantity Surveying) in Hong Kong and a Registered Cost Engineer in the PRC and an accredited mediator. He has been working as a quantity surveyor, project manager and client s representative in Hong Kong and China for over 25 years and is presently Director of Aria & Associates Ltd. He is also the Principal Director of Leigh & Orange Ltd which is a Hong Kong based international architectural practice founded in 1874 with projects in Hong Kong, Macau, S.E. Asia, Mainland China and Middle East. He is an Adjunct Professor of The Chinese University of Hong Kong, Honorary Professor of The University of Hong Kong and Advisory Professor of the Tongji University. Mr. Frank Yu Mr. Frank Yu is Design Principal of Gravity Partnership Limited. Born in Hong Kong, Frank received his education in the United States from the age of 12. He studied architecture at Pratt Institute, New York, and after graduating in 1986, was invited to join the largest architectural firm in the US Ellerbe Beckett New York as a Design Architect. He has worked on various renowned projects and international design competitions, and has won numerous awards. In 2000, Frank decided to return to
