2 WELCOME Welcome to Noosa and to the 18th Annual Colloquium of the Judicial Conference of Australia. Once again, there is an outstanding programme of eminent speakers across a broad range of subjects of professional and public interest. We are very grateful to all our speakers and commentators and we are especially privileged to have the keynote address given by Justice Keane of the High Court of Australia. The high standard of these colloquia does not happen by accident: it occurs by the work of the organising committee, members of which this year have been Chief Justice Alan Blow OAM, Justice Stephen Rares, Justice Roslyn Atkinson, Judge Michael Baumann and Magistrate Marc Sargent. The JCA is again fortunate to have the services of our conference coordinators, A.M. Meetings Plus, led by Aghi Di Maio and Mila Maisano. I thank them for their patience and work in doing all the many things necessary to ensure the success of this colloquium. This very stimulating program will be enhanced by the contributions of you all and I encourage you to participate in the discussions within the sessions. It is the combined experience and knowledge of all delegates which is critical for the rewarding experience of these colloquia. 3 SPEAKER BIOGRAPHIES The Hon Justice Roslyn Atkinson, Supreme Court of Queensland Justice Roslyn Atkinson has been a judge of the Supreme Court of Queensland since Her Honour holds a Bachelor of Laws (with First Class Honours), Bachelor of Education Studies (1975) and Bachelor of Arts (Hons) (1970) from the University of Queensland. Her Honour was admitted as a barrister of the Supreme Court of Queensland in 1987 and practised at the bar in Queensland from 1987 to Prior to appointment to the bench, Justice Atkinson was appointed as the first member of the Queensland Anti-Discrimination Tribunal and then as President of the Tribunal. Justice Atkinson has also served as Commissioner of the Queensland Law Reform Commission ( ), as Deputy Chair of the Commission ( ) and Chair of the Commission from 2002 until Professor Maxwell Bennett AO, Professor of Neuroscience, Chair: Brain & Mind Institute, University of Sydney Professor Maxwell Bennett is the Professor of Neuroscience and holds the first University Chair at the University of Sydney for research recognized internationally to be of exceptional distinction. His over 350 papers are concerned with synaptic connections between nerve cells in the brain. Professor Bennett has written eight books on the history and philosophy of the brain and mind, including History of The Synapse, Virginia Woolf and Neuropsychiatry, The Idea of Consciousness and with Peter Hacker, Philosophical Foundations of Neuroscience, Neuroscience and Philosophy and History of Cognitive Neuroscience. Amongst the organizations he has initiated to promote the amelioration of brain and mind disabilities are the Federation of Australian Scientific and Technological Societies, the International Society for Autonomic Neuroscience, Brain and Mind Research Asia/ Pacific, the Tropical Brain and Mind Research Foundation and The Brain and Mind Research Institute. The Hon Peter Collins, AM QC After editing the Sydney University Law School magazine Blackacre, Peter Collins joined ABCTV on graduation and reported for the ground breaking THIS DAY TONIGHT. Admitted to the NSW Bar in 1976, he was a foundation member of Edmund Barton Chambers, and also the Communications & Media Law Association. Elected to the NSW Parliament in 1981, he served in six portfolios in the Greiner/Fahey Governments including Attorney General when he took silk. After a term as Leader of the Opposition, he left Parliament in A long term Naval Reserve officer, he served as the RAN s Fleet Legal Officer for several months in and, in 2007, saw active service leading an ADF legal team in Iraq. Peter Collins founded Barton Deakin Government Relations in He also chairs Industry Super Australia; is a director of HOSTPLUS; and, is a regular ABC political commentator. The Hon Justice Catherine Holmes, Court of Appeal, Supreme Court of Queensland, former President, Mental Health Court, Queensland Justice Catherine Holmes is a Justice of Appeal of the Supreme Court of Queensland. While in practice, Justice Holmes was at various times a part time member of the Anti-Discrimination Tribunal, Deputy President of the Queensland Community Corrections Board and Counsel assisting the Forde Commission of Inquiry into Child Abuse. Her Honour was appointed to the Supreme Court of Queensland in March She was the judge overseeing the Court s criminal list for some years, and was the judge constituting the Mental Health Court from February 2005 until May 2006, when she was appointed to the Court of Appeal. Justice Holmes was the Commissioner of the Commission of Inquiry into the Queensland Floods

4 SPEAKER BIOGRAPHIES The Hon Justice Patrick Keane Justice Patrick Keane was awarded the degree of BA by the University of Queensland in In 1976 he was awarded the degree of LL.B. (Hons.) with First Class Honours and the University Medal in law. In 1977 he was awarded the degree of B.C.L. (Oxon.) with First Class Honours, and the Vinerian Scholarship and J.H.C. Morris Prize. In December 1977 he was admitted as a Barrister of the Supreme Court of Queensland appearing principally in commercial and constitutional cases. In November 1988 he was appointed Queen s Counsel. From 1992 to 2005 he was Solicitor-General for Queensland. On 21 February 2005 he was appointed to the bench of the Court of Appeal, Supreme Court of Queensland. On 22 March 2010 he was appointed Chief Justice of the Federal Court of Australia. On 8 December 2011 he was awarded the degree of Doctor of Laws honoris causa by the University of Queensland. On 1 March 2013 he was appointed to the High Court of Australia. The Hon Justice Betty King, Supreme Court of Victoria Justice Betty King is a judge of the Supreme Court of Victoria. She joined the Victorian Bar in In 1986 she became the first female Prosecutor in Victoria, later becoming the first female Commonwealth prosecutor. In 1992 she was made Queen s Counsel. During the late 1990s she was a member of the National Crime Authority at one point acting as chair of the authority. She became a judge of the County Court of Victoria in 2000 and a judge of the Supreme Court of Victoria in Chief Justice Christopher Kourakis Chief Justice Christopher Kourakis was admitted to practice in He had been articled at Johnston Withers McCusker. He worked at the Legal Services Commission for several years and then at a suburban practice before going to the Bar in He was the Legal Services Commissioner from He took silk in Chief Justice Kourakis was President of the Law Society in He was appointed as Solicitor-General for the State of South Australia in February 2003, and to the bench of the Supreme Court of South Australia in August Chief Justice Kourakis was appointed as Chief Justice of the Supreme Court of South Australia in June Chief Magistrate Peter Lauritsen, Magistrates Court of Victoria Chief Magistrate Lauritsen was appointed as Chief Magistrate in November 2012 after first being appointed as a magistrate in 1989, and Deputy Chief Magistrate in Between 1987 and 1989, Peter Lauritsen was a magistrate for the Northern Territory. During his career, Mr Lauritsen has taken on a range of responsibilities in relation to the management and operation of various Courts and Tribunals, and chaired a range of committees such as the Civil Rules Committee and the Court s Dispute Resolution Committee. Externally, he has represented the Court on numerous committees, bodies, boards and advisory groups including the Council of Legal Education, The Courts Library Committee, and the Judicial Officer s Aboriginal Committee. Mr Lauritsen chairs the Civil Procedures Advisory Group. Ms Rebekah Leong Rebekah Leong was admitted as a solicitor in 2004 and has worked in the private, government and community law sectors. She started with Queensland Advocacy Incorporated in January 2010, a community legal centre which provides legal representation to vulnerable people with disability, including before the Mental Health Review Tribunal and in guardianship and administration matters. In September 2011, she moved into the role of principal solicitor. Recently, she has been working with law firm Allens to produce a handbook for Queensland practitioners on legal capacity. David Marr David Marr is a journalist, biographer and broadcaster. He wrote for Fairfax off and on for 30 years. At the ABC he presented Arts Today on Radio National and Media Watch. He s written a number of books including biographies of Garfield Barwick and Patrick White. Lately he has written a series of controversial Quarterly Essays the latest being The Prince: Faith, Abuse and George Pell. He now writes for Guardian Australia and The Saturday Paper and appears on the Insiders and The Drum.

5 SPEAKER BIOGRAPHIES The Hon Justice Lucy McCallum, Supreme Court of NSW Justice McCallum went to North Sydney Girls High School and the University of New South Wales, graduating with a BA/LLB in She worked at Mallesons Stephen Jaques until 1988 when she became a prosecutor in Canberra and later Brisbane. She became a barrister in Sydney in 1991 taking silk in Her Honour was among the counsel assisting the HIH Royal Commission and is particularly proud of Day 37. Justice McCallum was appointed a judge of the Supreme Court of New South Wales in She and her partner have a combined family of four children. Their house is filled with pets, laughter, books, music and sporting equipment and is not very tidy. The Hon Robert McClelland Robert McClelland has been a legal practitioner for over 30 years and is currently a Partner at Carroll and O Dea Lawyers. Robert served as the Federal Member for Barton from 1996 until He was the Commonwealth Attorney General between 2007 and During that period Robert was responsible for a number of reforms including in the areas of family law, human rights, national security, personal property securities, and alternative dispute resolution. Robert is widely published in many areas of the law. He is a Director of LEADR and is a visiting Fellow of the UNSW where he teaches a course in Industrial law. The Hon Justice Simon Moore, High Court of New Zealand Justice Moore was admitted to the Bar in 1982 and joined Meredith Connell as a solicitor, later becoming a partner. He was appointed Crown Solicitor for Auckland in 1994 and in 2008, appointed Senior Counsel, which has since reverted to QC. As Crown Solicitor, he was responsible for the oversight and prosecution of all major crime in the Auckland region. He was appointed Public Prosecutor for Pitcairn Island in 2000, counsel to the Irish Rugby Union for RWC 2011 and was lead counsel for police at the Royal Commission of Inquiry into the Pike River Mine tragedy. Justice Moore is married to Jane and they have three boys, two of whom followed their father into law. Chief Judge John Pascoe, AO, CVO, Federal Circuit Court of Australia Mr John Pascoe was appointed as Chief Judge of the Federal Circuit Court of Australia (formerly known as the Federal Magistrates Court of Australia) in John Pascoe is a graduate of the Australian National University and, after admission as a solicitor, became a partner in the legal firm, Stephen Jaques & Stephen (now Mallesons) in Prior to his appointment as Chief Judge, Mr Pascoe was Managing Director in the national law firm, Phillips Fox. His practice has been in insurance law, risk management and government regulation. He has broad commercial experience, including a period as CEO of a public company and has been Chairman of a number of listed companies and statutory authorities. Chief Judge Pascoe was Deputy Chancellor and a member of the Council of the University of New South Wales and was Deputy Chair of the Institute of Early Childhood Foundation. He is a Patron of the LAWASIA Family Law and Family Rights Section. He is also a member of the Board of Trustees and the Advisory Board for the Cambodian Children s Fund Australia. He is a former member of the Board of Trustees of the Duke of Edinburgh s Award International Foundation (UK) and is an Honorary advisor and Regional meeting Chairman of the Duke of Edinburgh s Award International Association (Asia Pacific). He is a founding member of the Alumni of the Duke of Edinburgh s Award in Australia. He was appointed a member in the General Division of the Order of Australia in 1994, an Officer in the General Division of the Order of Australia in 2002 and was awarded a Centenary Medal in He was appointed a Commander of the Royal Victorian Order in January 2010.

6 SPEAKER BIOGRAPHIES The Hon Greg Smith, SC Greg Smith graduated from Sydney University with an LLB and practised as a solicitor from admission in Greg was admitted to the Bar in 1987 and appointed a NSW Crown Prosecutor in the same year. He was appointed the Deputy Director of Public Prosecutions in April of Before leaving the DPP Greg was appointed a Senior Counsel in September Greg was elected as the Member for Epping in March 2007 and soon after was appointed as the Liberal Party s Shadow Attorney General and Shadow Minister for Justice and Shadow Minister for Juvenile Justice in the New South Wales Parliament. In March 2011 Greg was re-elected to the seat of Epping for a second term and in April he was appointed Attorney General and Minister for Justice in the incoming Farrell Government. Greg was the State s 55th Attorney General until he was replaced in that and the Justice portfolio by the Hon Brad Hazzard. He continues to serve as the Member for Epping and Chair of the Joint Select committee on the Independent Commission against Corruption. Mr Warwick Soden, Principal Registrar & Chief Executive Officer, Federal Court of Australia Warwick Soden has been the Registrar and Chief Executive of the Federal Court of Australia since Prior to that he was the Chief Executive and Principal Registrar of the Supreme Court of New South Wales from He was admitted to the NSW Bar in He has been a member of the Australasian Institute Judicial Administration (AIJA) for 11 years and of the National Alternative Dispute Resolution Advisory Council (NADRAC) for 13 years. Dr Frank Varghese, forensic psychiatrist, sits on the Mental Health Court Dr Frank Varghese is an Associate Professor at the University of Queensland. He graduated in medicine in 1972 and obtained the FRANZCP qualification in He has worked in public mental health in services in Victoria and Queensland including in senior positions and is now in private practice. Previously Dr Varghese s principal areas of research were in the area of phenomenology and course of psychotic disorders. Later he has focused on end of life decisions in the terminally ill. He has published research findings in international journals. Dr Varghese has wide experience in medico-legal psychiatry. Since appointment as an Advisor to the Mental Health Court of Queensland he has ceased practice in criminal law evaluations, but continues an active interest in family law and personal injuries. A particular interest has been the role of personality in Family Court disputation and in the assessment of claims of childhood sexual abuse by parents. In the personal injuries area he is interested in iatrogenic influences in the presentation and outcome of psychiatric disorders. Tony Woodyatt, Director, QPILCH Tony Woodyatt is the Director of the Queensland Public Interest Law Clearing House Incorporated. He has been involved in legal and public policy work since He has worked as the manager of Crime Prevention Queensland; executive director of the Queensland Police Service Review; director of Caxton Legal Centre; research director of the Parliamentary Criminal Justice Committee; and solicitor and coordinator of the Prisoners Legal Service. Matt Wordsworth, ABC 7:30 Queensland Matt Wordsworth is a senior reporter with the Australian Broadcasting Corporation and is the current host of 7.30 Queensland. He has been a working journalist for almost 20 years starting in print before moving to radio and television. Matt has been State Political Reporter for ABC TV in both Queensland and New South Wales covering a number of elections. He has also been dispatched to disaster zones and on foreign assignment.
