All changes enhance accessibility above the 2009 Standard and may be used as guidelines, if desired, to go above and beyond current minimum requirements. 5 Employee Work Areas Employee Work Areas Definition: All or any portion of a space used only by employees and only for work [Section 1102] Definition:... Corridors, toilet rooms, kitchenettes, and break rooms are not employee work areas. 6 Accessible Route Accessible Route (GENERAL SCOPING) Components. routes shall consist of one or more of the following components: walking surfaces with a slope not steeper than 1:20 doors and doorways Ramps curb ramps excluding the flared sides Elevators platform lifts. (SPECIFIC SCOPING) Accessible building entrance components. Accessible building entrances shall provide an exterior accessible route consisting of one or more of the following components: walking surfaces with a slope of not steeper than 1:20 doors and doorways curb ramps excluding the flared sides Elevators platform lifts. Note: Ramps are not on this list. Slope of exterior accessible routes shall be 1:20 maximum. Accessible Route (SPECIFIC SCOPING) Components within a site. Buildings, facilities, elements, and spaces that are required to be accessible and are on the same site shall be connected by an accessible route consisting of one or more of the following components: walking surfaces with a slope of not steeper than 1:20 doors and doorways curb ramps excluding the flared sides Elevators platform lifts. Note: Ramps are not on this list. Slope of exterior accessible routes shall be 1:20 maximum. Accessible Path of Travel (interior) All levels of a building must be located on an accessible route unless provided with an exception. [IBC and IBC (1341)]. 7 Accessible Path of Travel (interior) Mezzanines and stories above and below an accessible level with an occupant load of 30 or less are not required to be located on an accessible route [IBC (1341)]. Accessible Path of Travel (interior) NO EXCEPTION FOR THE FOLLOWING OCCUANCIES Public areas of Group M occupancies Public areas of health care facilities Exempt if No more than 30 people. Accessible Level Public areas of passenger transportation facilities and airports Public areas of government facilities [IBC (1341)] Accessible Route (exterior) Exterior accessible routes leading to accessible building entrances shall: Have a running slope of 1:20 max. [ANSI (1341)]. And Be 48 inches wide minimum [ANSI (1341)]. 1:20 Slop Exceptions: Accessible Route Buildings, facilities, elements, and spaces not normally occupied shall be permitted to provide an accessible route by means of a ramp. A ramp can be considered in Group R-2, R-3, and R-4 occupancies where a slope not steeper than 1:20 is not feasible. 27 7

9 Parking Facilities Accessible Route from Parking Stalls Access Aisles shall have surface slopes not steeper than 1:48 and shall be at the same level as the parking space they serve. [ANSI 502.5]. Built up curb ramps are not permitted in parking access aisles. Parking Facilities Access aisles signage shall be marked with the designation no parking centered at the head end of the access aisle and mounted between 60 inches and 66 inches above the access aisle surface. [ANSI (1341)] Parking Facilities Where a sign would conflict with the accessible route, the no parking designation can be provided on the surface of the access aisle [ANSI (1341)]. Existing parking lots New striping due to seal coating, resurfacing or reconfiguring shall be accessible. Refreshing existing striping due to fading shall be allowed. 10 Assembly Seating Assembly Seating Quantity: Assembly areas with fixed seating shall provide wheelchair spaces in accordance with the table [IBC ]. 14 Drinking Fountains Drinking Fountains No fewer than two drinking fountains shall be provided. Where drinking fountains protrude above 27 side protection shall be provided. 15 Platform Lifts Detectable Warnings Permitted in existing buildings at any location where an accessible route is required. [Scoping Section ] Only required at: Passenger transit platform edges (train platforms). Pedestrian circulation paths that cross tracks [MN Scoping Section ] Changing Benches Service Counters: Dressing Rooms, Fitting Rooms and Locker Rooms where people change clothes shall have an accessible bench within the changing room. [ANSI 803] On the public side of service counters, the accessible section shall extend the same depth as the non-accessible portion of the sales and service counter top. [ANSI 904.3] 15

16 Service Counters: Additions to Existing Buildings The front half of service counters is considered the public side, which is the side required to comply. The back half of service counters are employee work areas and are exempt. Additions: Provisions for new construction shall apply. To the maximum extent feasible, be located on an accessible route from an accessible main entry. Existing toilet rooms, parking, telephones or drinking fountains that serve the addition shall comply with the 20% Rule. [IBC ](MN 1341) Alterations: Alterations to Existing Buildings Each altered element, space, feature, or common area shall comply with provisions for new construction. The alteration shall provide accessibility to the maximum extent technically feasible. [IBC and ](MN 1341) The 20% Rule for Additions & Alterations: In addition to the planned scope of work: Alterations and additions that affect a Primary Function area trigger upgrades along the route leading to the PF area, including: 1. Accessible path of travel (exterior & interior) 2. Accessible toilet facilities 3. Accessible parking 4. Accessible telephones 5. Accessible drinking fountains These elements leading to, and serving the addition or altered area, shall be made to be accessible, up to 20 percent of the construction cost, in the above order of priority. [IBC and and ](MN 1341) 16

17 The 20% Rule for Additions & Alterations: The 20% Rule for Additions & Alterations: Only triggered when you alter a primary function space. E.g.: If the facility is a parking facility, the primary function is parking. So alterations to the parking will trigger the 20% rule for that facility. If the facility is a commercial facility, the primary function is any space used by the public as well as employee work spaces. So alterations will be triggered to the list of elements along the route to the primary function. Up to 20 percent of the construction cost. Generally calculated on construction cost listed on the permit application. Can deduct fees. The 20% Rule for Additions & Alterations: Does not apply to: projects limited solely to electrical, mechanical, or plumbing system work, or to hazardous material abatement, or to automatic sprinkler installation/retrofitting. projects limited solely to windows, hardware, operating controls, electrical outlets, and signs. alterations undertaken for the primary purpose of barrier removal. [MN Exceptions 1, 2, and 3] The 20% Rule for Additions & Alterations: EXCEPTION: Where tenants alter their own space: Allows tenants to alter their own space without triggering any common area work outside their space under the landlord s control. Tenant only modifies the 20% rule elements that fall within their own space. Both the MN Accessibility Code and the Federal ADA have allowances [MN Exception 4]. 17

18 20% Rule for Additions & Alterations 20% Rule for Additions & Alterations Both the MN Accessibility Code and the Federal ADA have this 20% Rule language. Minnesota adds Parking to the list Change of Occupancy to Existing Buildings Changes of occupancy shall comply with Sections 1111 to 1113, which includes the 20% rule for features along the route to an area of primary function, if alterations are undertaken. [IBC 1113](MN 1341) The following features shall be brought into compliance (if they aren t already), regardless of whether or not an alteration is undertaken as part of the change of occupancy. Change of Occupancy to Existing Buildings Existing buildings or portions of buildings that undergo a change of group or occupancy classification shall have all of the following accessible features completed: Accessible building entrance Accessible route to primary function areas Compliant signage if provided Accessible Parking Accessible route from parking to accessible building entry Accessible restrooms, not more than one story above or below a floor without restroom facilities. There is no cap at 20% These items shall comply to the maximum extent technically feasible. [IBC 1113](MN 1341) 18
