14 HOW TO BECOME A GOOD RENTER Use the fllwing as a guide when thinking abut Hw t Becme a Gd Renter. GOOD HOUSEKEEPING HABITS FOR RENTERS AND HOMEOWNERS Establishing a gd rental histry is extremely imprtant when yu are cnsidering mving int anther rental situatin r thinking abut purchasing a hme. It is becming increasingly difficult t secure decent, safe and sanitary husing withut gd rental histry. Generally, the first item a prperty wner r manager reviews is yur credit histry. If yu are cnsistently late in paying yur rent, chances are yu will experience difficulty finding a suitable place t live. Often times, previus landlrds will be cntacted t discuss yur rental histry. Sme prperty wners r managers will stp by yur current address t check husekeeping skills befre yur applicatin is apprved. 1. When shpping fr a rental unit, yu shuld make a list f yur wants and needs. Fr example, the number f bedrms, bus service, prximity t grcery stres, wrk, childcare and schls. Yu shuld explre the surrunding area as well. Being satisfied with the rental unit and the neighbrhd creates a psitive climate fr becming a gd renter. 2. Prir t signing a lease, yu shuld read every wrd and be sure that yu clearly understand what yu are signing. Write dwn any questins that yu have and discuss them with the prperty wner befre signing the lease. 3. Ask the landlrd t walk thrugh the unit with yu befre mving in. Taking pictures f the vacant unit and perfrming a Tenant/Landlrd Inspectin Check-ff List will prvide yu with the necessary prf f pre-existing cnditins in rder t be able t recver yur security depsit when yu mve. 4. Paying rent n r befre it is due is the mst imprtant element f becming a gd renter. Knw where (the address) the rent is t be paid and if the rent is t be paid directly t the landlrd r by mail. If it is t be paid by mail, take cautin fr any mailing delays. Renters, wh cnsistently pay their rent during the grace perid (i.e. nt n the due date), are NOT cnsidered t be gd renters. This culd als have a negative impact n yur credit histry. If yu pay yur rent with cash, it is very imprtant that yu btain a receipt with all f the infrmatin recrded (name, date, amunt paid). If the rent is paid by check r mney rder, yu can use yur canceled check r the carbnized cpy f the mney rder, as yu receipt. Yu shuld set up a filing system just fr rental payments. 5. If yu are experiencing difficulty in paying yur rent n time, yu shuld immediately cmmunicate this t yur landlrd. Ntifying the landlrd in advance, demnstrates hw imprtant timely rent payments are t yu and shws that yu are cncerned. If there is a need t establish special payment arrangements with the landlrd, never agree t any arrangements that yu cannt keep. This will destry the landlrd s trust in yu. Hnesty is the best plicy. 6. If yu are respnsible fr paying a prtin r all f the utilities, it is imprtant that this cmmitment be paid n r befre the due date. Utility cmpanies reprt payment histries t credit bureaus, which culd negatively impact yu in the future. The respnsibility f the utility payments must be clearly spelled ut in the lease agreement. 15 7. Prperty wners frm time t time may cnduct inspectins f the rental unit. This activity shuld be clearly spelled ut in the lease with written ntice prvided t yu, at least 24 hurs in advance. The purpse f the inspectin is t determine the cnditin f the unit. If the cnditin is fund t be unacceptable, nrmally, the landlrd will site yu and give yu a limited amunt f time t cure the identified prblems. If yu have nt satisfactrily reslved the prblems, evictin prceedings can begin. Hwever, the practice may vary frm landlrd t landlrd. 8. If yu decide t terminate the rental agreement, yu must take care t fllw the terms f the lease. If the terms f the lease agreement have nt expired, yu may be held respnsible fr paying a lump sum amunt t satisfy the remaining amunt f the time left n the lease. Generally, a 30-day written ntice t the landlrd is required befre mving ut. Yu shuld always request a mve-ut inspectin with the landlrd. This shuld be cnducted as quickly as pssible, after yu have remved all f yur belngings. The mve-ut inspectin can be cmpared t the mve-in inspectin, making it easy t determine if there were any damages caused by yu while ccupying the unit. If any damages were caused after mve-in, the landlrd generally keeps a prtin f the security depsit t cver the cst f the repairs. If yu did nt pay a security depsit, yu may be charged fr the identified damages. These tw inspectin reprts prvide yu with the necessary dcumentatin in the event f a disagreement. Once again, this practice may vary frm landlrd t landlrd. Terminating yur relatinship with a landlrd n gd terms is ne additinal step in establishing a gd rental histry. Yu shuld be encuraged t develp a plan f actin fr perfrming regular husekeeping activities. Everyne in the family shuld be assigned a husekeeping task, even if it is small. Living in a well-rganized and clean envirnment builds a sense f pride f wnership, even if yu are renting. Sme cities and cunties 1 have the Unifrm Residential Landlrd and Tenant Act (Urlta), a law which applies t mst rental prperty (htels, hspitals, grup living situatin, and emplyment-based rentals are nt cvered). URLTA gives tenants and landlrds many rights as well as duties. URLTA: Either the lease has expired, r the tenant has materially breached the lease. This means the reasn cannt be a small r petty ne. Nn-payment f rent r any part f the rent is a material breach and a gd reasn fr evictin. The #1 rule fr tenants: Pay the rent. NON-URLTA: If there is n lease, the landlrd des nt need a reasn. Where there is a lease, the landlrd wants the tenant ut befre the lease is up, they must shw that the tenant breached (brke) the lease. WHAT KIND OF NOTICE MUST A LANDLORD GIVE A TENANT WHEN THEY WANT THE TENANT TO MOVE OUT ( VACATE )? URLTA: If the reasn the landlrds says the tenant has t mvie is because f nn-payment f rent, the landlrd must give at least 7 days ntice. Fr any ther reasn, they must give 14 days ntice. The ntice must be in writing, either hand-delivered r sent by registered/certified mail. NON-URLTA: The amunt f time is whatever the lease requires. Hwever, if the leases has expired, r if there is n lease r lease clause n the subject, the landlrd must give the tenant 30 days ntice in writing. WHAT IF THE TENANT HAS NOT MOVED OUT BY THE TIME THE LANDLORD TOLD THEM TO? URLTA: If, when the time has run ut, the tenant has fixed the prblem (paid the verdue rent, r gtten rid f the pet, etc.), then the landlrd must allw the tenant t stay. If nt, then the landlrd can file a curt actin t get the tenant ut. NON-URLTA: If the landlrd has given the right amunt f ntice and the tenant des nt leave, the landlrd can then file a curt actin t get the tenant ut. HOW MUCH ADVANCE NOTICE MUST A TENANT GET BEFORE COURT? URLTA AND NON-URLTA: The tenant must receive ntice at least three days befre the curt date. 17 WHAT HAPPENS IN LANDLORD-TENANT COURT? Only One Issue: These cases are called frcible detainer cases. They are special, shrtened curt cases that deal nly with the issue f wh has a right t be n the prperty, the landlrd r the tenant. Regarding mney, the curt will lk at whether (but nt hw much) the tenant is behind in rent, because that will determine if the tenant has brken the lease. But the curt will nt decide wh wes hw much the nly rder will be either an evictin f the tenant r a dismissal f the landlrd s case. 2 Appearances: If the tenant des nt shw up, the judge will grant the landlrd the right t have them and their things taken ff the premises by the sheriff n the 7 th day after the curt hearing. If the tenant shws up but the landlrd desn t, the judge will dismiss the case. (The tenant will nt be evicted.) If bth parties appear, the judge will call the case and expect the parties t state what they think the curt shuld rule and why. Witnesses: Bth parties have a right t bring r subpena (rder the appearance f) witnesses; a subpena frm may be btained frm the curt clerk. Extra time will nt be given nce the case is called, s a tenant must have the subpena issued ahead f time; the witnesses must be present and ready t testify when the case is called. Defenses What can the tenant say in their defense? NON-URLTA: Failure t give required ntice. If the tenant can shw the curt that they did nt receive the prper (usually 30-day) ntice t vacate, r that they did nt receive at least 3 days ntice f the curt hearing, then the judge shuld dismiss the case, r put the hearing ff until the prper ntice has been given. Acceptance f current rent. Fr a tenant wh is behind in rent, if they can shw the curt that the landlrd, after giving the ntice t vacate, let the tenant pay the current mnth s rent, then the curt actin will be dismissed, because by taking the current rent the landlrd accepted the tenant fr a further term. The landlrd will have t start ver with a new curt actin at a later time. URLTA: A tenant has the abve defenses and these thers that NON-URLTA tenants dn t have: Right t cure. A tenant wh has brken the lease can shw the curt that in the meantime they fixed the prblem fr which the landlrd was trying t evict them (eg., paid the back rent, fixed the hle in the wall, etc.) Landlrd retaliatin. A tenant can prevent an evictin if they can prve t the curt that the landlrd is nly trying t get back at the tenant fr sme actin the tenant had a right t take such as reprting smething t the Health Department, jining a tenant unin, r withhlding rent t pay fr repairs. Credit fr rent withheld. A tenant wh has used past rent mney t pay fr repairs r needed utilities that the landlrd refused t make r prvide can shw the curt that they are nt behind in rent since they did pay the mney. (Tenants wh want t withhld their rent t make repairs must fllw very exact rules 3 fr ntifying the landlrd and spending the mney; therwise this is n defense t evictin. 2 It is rarely used this way, but the Frcible Detainer law als allws a tenant t sue a landlrd wh has imprperly taken pssessin f the premises. (This is called frcible Entry ). In such a case, the curt s ptins are t either rder the landlrd ff the premises, r dismiss the tenant s case. 3 Amng ther things, the repair must be necessary fr health and safety; the tenant must ntify landlrd 14 days ahead f time; and the repair cannt exceed ½ the rent (r $100, whichever is mre). 18 CAN A LANDLORD EVICT A TENANT FOR NOT PAYING LATE FEES? URLTA AND NON-URLTA: A tenant breaks their lease if they pay their rent late and dn t pay a required late fee. Hwever, a late fee must be reasnable, r else it will be cnsidered a penalty by the curt, and the curt may nt enfrce such a penalty. A reasnable late fee is ne that fits the amunt f truble late rent causes a landlrd a little extra bkkeeping, a tiny lss f interest. It can be argued that a late fee r mre than $5 r $10 is nt reasnable. CAN TENANTS GET THEIR SECURITY DEPOSIT BACK, EVEN IF THEY HAVE BEEN EVICTED? NON-URLTA: If a tenant is evicted withut wing the landlrd mney (r wing the landlrd less than the amunt f the security depsit), they can file a case in Small Claims Curt t get back the mney wed them. They cannt get an rder frm the Frcible Detainer (evictin) curt. URLTA: If a tenant leaves wing the landlrd rent, the landlrd can apply the security depsit mney t the rent bill after 30 days have passed. If the tenant desn t we back rent, r nt as much as the amunt f the security depsit, the landlrd must mail the tenant a ntice f the balance f the accunt and return the mney, unless the tenant des nt reply within 60 days f the ntice. The tenant can file a small-claims actin t get the security depsit back. The judge will decide hw much f the security depsit must be paid back. It must all be given back if the landlrd did give d certain things (tell the tenant, at mve-in, what bank accunt the mney is kept in; and have the tenant sign ff n inspectin frms shwing the cnditin f the premises befre and after the tenancy.)
