And shall not nor will erect or build upon the said piece of land situate on the west side of the said viaduct within five feet thereof any erection or building except such a building as upon or through which the said Company their successors or assigns can without difficulty exercise the rights and liberties hereinbefore reserved to them for the purposes aforesaid which building may be partially carried in or by the viaduct of the said Railway if the same building be constructed under the superintendence of and in a method to be approved of by the Engineer for the time being of the said Company their successors or assigns PROVIDED ALWAYS and it is hereby declared that if the said William Cranfield his heirs or assigns shall erect or built on the said piece of land situate on the west side of the said viaduct within five feet thereof any other erection or building than as aforesaid he the said William Cranfield his heirs or assigns shall and will to the extent of such five feet at his own expense when called upon by the said Company their successors or assigns so to do pull down and remove the same. AND the said William Cranfield for himself his heirs executors administrators and assigns doth hereby further covenant with the said Company their successors and assigns that he the said William Cranfield his heirs executors administrators or assigns will at his own cost construct such drains as he may require on the lands and hereditaments hereby granted and conveyed or intended so to be in such a way as will allow of all water running from or through the said viaduct on to the said land and hereditaments being carried off. 7 C: Charges Register continued PROVIDED always that the said Company their successors or assigns will and shall to pay to the said William Cranfield his heirs or assigns the sum of Fifteen pounds as a contribution towards the cost of such drains but the said Company their successors or assigns shall not be liable to any greater extent than the said sum of Fifteen pounds for any damage or injury caused by the running of water from or through the said viaduct.
